Запропоновано шляхи удосконалення положень КПК України з порушеного питання.The author of the article analyzed the procedural status of victim`s representative in criminal procedure according to the current criminal procedural legislation of Ukraine and its implementation. The author noted that during the Soviet period the procedural representation was considered largely regarding the suspect and the accused. According to the current Criminal Procedural Code of Ukraine several types of procedural representation were allocated, including: legal representation (if the person is a minor or incapable) of the victim, representation of civil plaintiff and the defendant and the legal entity (realized by the head or other person authorized by the law or charter documents and an employee of the legal entity by proxy). The author determined representation as a type of advocacy guaranteeing the rights of the victim, civil plaintiff, civil defendant in criminal proceedings. The author emphasized that the legal institution of representation does not include suspect, which is quite justified. The author supported scientific position of mandatory participation of lawyers of the victim in criminal proceedings, as well as clear consolidation of his procedural rights and duties. The author concluded that procedural representation, including determining the procedural status of victim’s representative, is important not only for theoretical but also for practical level, since it provides effective protection and realization of the rights and interests of the victim.С учётом действующего уголовного процессуального законодательства Украины и практики его применения исследован вопрос процессуального статуса представителя потерпевшего в уголовном производстве.
