The main international acts and modern publications reflecting the views on the problem have been researched. The author has noted certain aspects of the correlation and balance of interests in the competition of legal statuses based on imperative norms of international law or on the most significant principles of a democratic society protected at the international level. The author of the paper has analyzed legal privileges regulated by international norms, as well as the corresponding interpretation of norms by international courts and scholars, which is related to different approaches to the application of privileges, taking into account the dynamics of relations in the global sense, interpretations of the grounds for limiting various privileges. The author has analyzed the types of privileges in regard to the subjects, the nature of the relationship and, accordingly, the volume. In particular, special attention has been paid to state, diplomatic privileges, immunities of international organizations and their representatives, agents; mutual dependence with sovereign functions and other priority imperatives has been determined. It has been noted that state actions carried out for exercising sovereign power and actions of a private or commercial nature are distinguished in the doctrine, international and judicial practice. It has been emphasized that the sovereignty of states and their agents (with full, limited functional or minimal privilege) must be balanced with other interests that are important in a democratic society and whose provision is connected with the security of the state, with guaranteeing international courtesy and good relations between states, the compliance with the rule of law requirements. It has been determined that the approach from the point of view of establishing a balance between state privilege and human rights, which are seriously violated along with the imperative norms of international law, should be the fundamental basis for further development of international practice based on the rule of law. The dynamics of international practice and international justice demonstrate that the privilege of states is limited not only on the basis of convention provisions, but also on the basis of international customary law.
