Наголошено, що фінансово-правовий захист військовослужбовців, як система фінансово-правових відносин, складається в наслідок забезпечення соціальних прав військовослужбовців і повинна спиратися на правові засади, які розкривають фінансову діяльність держави в сфері розподілу та використання державних видатків, а також на постулати соціальної політики держави.The purpose of the article is to define the system of principles of financial and legal protection of military personnel, as a legal basis for state funding of special social rights of military personnel during the period of martial law in Ukraine. It was determined that the financial and legal protection of military personnel, as a system of financial and legal relations, is a consequence of ensuring the social rights of military personnel and should be based on the legal principles that reveal the financial activity of the state in the field of distribution and use of public expenditures, as well as on the postulates of the social policy of the state. It was emphasized that the legal canons of providing for military personnel should be considered as the legislative basis for financing the system of material measures - benefits, compensations, guarantees, which in difficult circumstances of the performance of professional duties provide assistance in the restoration of impaired body functions, provide psychological, physical, and moral support. The essence of financial and legal principles, principles of budgetary law, social security law, and principles of budgetary financing of expenditures, as a legal and economic basis for ensuring stable and effective financing of state social protection programs, is clarified. The imperfection of financing the social rights of military personnel has been established, which is related both to the amount of public financial resources in the country, and to the distribution and use of budget funds, as a stage of the budget process, which ensures effective protection of the material rights of citizens, in particular, military personnel. It has been proven that in the conditions of martial law, the state's fulfillment of financial obligations to military personnel is a guarantee of the country's defense success. A system of principles of financial and legal protection of military personnel is proposed, which, based on the constitutional rights of citizens, provides funding for the special rights of defenders of the homeland. It is noted that the introduction of current amendments to the financial legislation is a guarantee of the legality and stability of the state's performance of social functions, which will ensure the realization of the rights of military personnel to financial and legal protection.Определены современные принципы финансово-правовой защиты военнослужащих в условиях военного положения в Украине, как основы обеспечения особых социальных прав путём эффективного государственного финансирования.
