Акцентовано, що судовий захист є основоположним способом захисту та відновлення порушених прав мігрантів. Наголошено, що судовий захист прав трудових мігрантів передусім визначається нормами міжнародного права, проте регулюючу функцію у цій сфері безпосередньо виконує держава працевлаштування, з урахуванням особливостей національної правової системи. В Україні виникають певні труднощі під час імплементації норм міжнародного права до національного законодавства, також і тих норм, які стосуються трудових прав мігрантів, що заважає реалізації мігрантами, зокрема, свого права на судовий захист. Підкреслено, що Україні потрібно вдосконалювати міграційну політику та законодавство в цій сфері, а також розглянути можливість запровадження відповідної посади (спеціаліст із трудових та соціальних прав мігрантів) у регіональних центрах зайнятості Державної служби зайнятості України. До компетенції зазначеної посадової особи віднести надання консультативної допомоги трудовим мігрантам під час реалізації ними права на судовий захист.The relevance of the article is that with the deepening of globalization processes in the world, labor migration is becoming more widespread. The reasons for such a phenomenon as migration can be various: economic; political; national; external (unsatisfactory security situation in the country; unsatisfactory environmental situation in the country; negative assessment of the legal field); internal (concerns about their own safety or the safety of loved ones; discrimination; gender aspects, etc.). Most migrants see this as an opportunity for a better life, as well as an opportunity to find a better job with decent working conditions. Successful integration of migrant workers for any country means socio-economic development and stability. But due to fears of threatening the ethnic, religious, linguistic component of a society, the anti-immigration sentiments of the national majority hinder the successful assimilation of migrant workers, who very often suffer violations of their rights. The right to judicial protection is central to the system of protection of migrants’ labor rights. The article is devoted to the scientific research of the peculiarities of judicial protection of labor rights of migrants. The study emphasizes that judicial protection is a fundamental way to protect and restore violated migrants’ rights. It is concluded that judicial protection of the rights of migrant workers is primarily determined by the norms of international law, but the regulatory function in this area is directly performed by the state of employment, taking into account the peculiarities of the national legal system. In Ukraine, there are some difficulties in the implementation of international law to national law, as well as those rules relating to the labor rights of migrants, which hinders the realization of migrants, in particular, their right to judicial protection. Therefore, Ukraine needs to improve migration policy and legislation in this area, as well as consider the possibility of introducing an appropriate position (specialist in labor and social rights of migrants) in the Regional Employment Centers of the State Employment Service of Ukraine. The competence of this official includes the provision of advisory assistance to migrant workers in exercising their right to judicial protection.Исследованы особенности судебной защиты трудовых прав мигрантов. Акцентировано, что судебная защита является основополагающим способом защиты и восстановления нарушенных прав мигрантов. Отмечено, что защита прав трудовых мигрантов прежде всего определяется нормами международного права, однако регулирующую функцию в этой сфере непосредственно выполняет государство трудоустройства, с учетом особенностей национальной правовой системы.ukТрудове право.
