dc.description.abstractУ статті обґрунтовано доцільність запровадження в науковий оборот та чинне цивільне законодавство України такого поняття, як «статусна покупка», що може бути різновидом марнотратства і підставою обмеження цивільно дієздатності фізичної особи. Автором визначено «статусну покупку» як придбання речей за певну грошову суму, яка в більшості своїй виходить за межі розумної їх вартості, з єдиною метою затвердити (відобразити) свій певний соціальний статус у сучасному суспільстві. Доведено, що укладення «статусної покупки» в певних випадках може свідчити про марнотратство з боку фізичної особи. Запропоновано передбачити марнотратство в Цивільному кодексі України як підставу обмеження цивільної дієздатності фізичної особи, що сприятиме удосконаленню правового механізму здійснення та захисту суб’єктивних цивільних прав фізичної особи.uk_UA
dc.description.abstractThe author of the article has substantiated the expediency of implementing the concept such as the “trophy purchase” into the scientific circulation and the current civil law of Ukraine that may be a kind of spendthrifting and a reason for limiting the civil capacity of an individual. The author has defined the “trophy purchase” as buying things for a certain amount of money, which in most cases goes beyond the reasonable value, in order to affirm (represent) the particular social status in modern society. It has been proved that things that are the object of the “trophy purchase” are not intended to satisfy everyday or other necessary needs of an individual and are acquired by an individual solely for the purpose of seizing them as prestigious. While making the “trophy purchase”, it is the motive that is the basic element for the conclusion of the transaction. There could not be an error in the motive for a person, who makes the “trophy purchase”. It has been argued that the conclusion of the “trophy purchase” pursues the goal of demonstrative consumption without the necessary need to use useful properties of such a thing, is such a social consumption that demonstrates a certain status of a certain layer of the population (elite) that goes beyond the majority of the population. The conclusion of the “trophy purchase” and the acquisition of appropriate things indicate that an individual belongs to such a layer of society and has a standard of living that exceeds a sufficient standard of living for a person and his family that includes adequate food, clothing, housing. It has been proved that the conclusion of the “trophy purchase” in certain cases may indicate a kind of spendthrifting by an individual. It has been analyzed that spendthrifting was distinguished in the civil law in pre-revolutionary Russia as the basis for limiting the civil capacity of an individual. The author has offered to foresee spendthrifting in the Civil Code of Ukraine as the basis for limiting the civil capacity of an individual, which will contribute to the improvement of the legal mechanism for the implementation and protection of subjective civil rights of an individual.en
dc.description.abstractВ статье обосновывается целесообразность введения в научный оборот и действующее гражданское законодательство Украины такого понятия, как «статусная покупка», которая может быть разновидностью расточительства и основанием ограничения гражданской дееспособности физического лица. Автором определена «статусная покупка» как приобретение вещей за определенную денежную сумму, которая в большинстве своем выходит за пределы разумной их стоимости, с целью утвердить (отразить) свой определенный социальный статус в современном обществе. Доказано, что заключение «статусной покупки» в определенных случаях может свидетельствовать о расточительстве со стороны физического лица. Предложено предусмотреть расточительство в Гражданском кодексе Украины как основание ограничения гражданской дееспособности физического лица, что будет способствовать совершенствованию правового механизма осуществления и защиты субъективных гражданских прав физического лица.ru
