Анотація
У статті з’ясовано, що інновації в судовій системі досліджувалися зарубіжними науковцями з таких точок зору, як: організаційно-управлінська із застосуванням адміністративних прийомів; судових інновацій з акцентом на законодавчі зміни та судові процедури; технологічних інновацій з дослідженням використання інформаційно-комунікаційних технологій. Джерелом впровадження подібних інновацій виступає міжнародне
партнерство, вивчення зарубіжного досвіду організації діяльності судів.
The article revealed that innovations in the judicial system were studied by foreign scientists from such points of view as: organizational and managerial with the use of administrative techniques; judicial innovations with an emphasis on legislative changes and court procedures; technological innovations with research on the use of information and communication technologies. The source of the implementation of such innovations is international partnership, the study of foreign experience in the organization of court activities. At the level of technological innovation, such a direction of electronic governance as the electronic justice system was analyzed. The question of the formation of an electronic court was considered by us not only through the prism of digitization or automation, but much broader aspects of IT infrastructure, human capital, electronic documentation system, queue management system, case management system, recording and transcription of court sessions and video conferences, digitization of forensic examinations were raised, data protection during the operation of a modern court, restructuring of the concept of physical court security, other security tools, such as alarms, video surveillance, handheld scanners and metal detectors, use of information platforms during the training of future judges. On the basis of the peculiarities, technical innovations and organizational and management decisions in the activity of courts in various countries of the world, we identified the possibilities of their use in Ukraine. Thus, in the field of digital transformation and the use of information technologies in the course of organizing the activities of domestic courts, we consider it appropriate to develop action plans for cyber situations in the field of court activity at the level of subordinate legal acts, to organize training for employees of the court apparatus and judges in cyber security, including with using specially developed interactive training and educational programs, stimulation by the state and international research and development grant programs in the field of court information security. In the course of improving domestic legislation, it is proposed to consolidate the basis of a high ethical and aesthetic culture of judges and court staff in accordance with the Code of Judicial Ethics and High Standards of Conduct as a worldview basis for the administration of justice in the text of the Law of Ukraine «On the Judiciary and the Status of Judges» dated June 2, 2016 № 1402- VIII.
