Анотація
У статті досліджуються проблеми, що існують в організації адвокатської діяльності в Україні та
пропонується концепція, яка передбачає реформування органів адвокатського самоврядування, забезпечення ефективної дисциплінарної відповідальності адвокатів, зміцнення ролі адвокатів у правозахисній діяльності, а також підвищення рівня професійної майстерності адвокатів. Визначено основні напрями удосконалення
організаційних основ адвокатури в Україні, а саме: зміцнення ролі адвокатського самоврядування, підвищення якості навчання та професійної підготовки адвокатів, розширення можливостей надання адвокатських послуг, забезпечення дієвого контролю за діяльністю адвокатів та розробка та впровадження нових технологій
та інформаційних систем у роботу адвокатів.
This scientific article examines the concept of improving the organizational foundations of the legal profession in Ukraine. An analysis of research and publications by domestic authors on this topic was carried out, the main areas of improvement of the organizational foundations of advocacy were determined, in particular, strengthening the role of advocate self-governance, improving the quality of education and professional training of advocates, expanding the possibilities of providing advocate services, ensuring effective control over the activities of advocates, and the development and implementation of new technologies and information systems in the work of lawyers. The need for a comprehensive approach and joint work of all interested parties for the implementation of the above directions is highlighted, which will increase the level of public trust in the lawyer profession and contribute to the development of democracy and the rule of law in Ukraine. The article examines the problems that exist in the organization of advocacy activities in Ukraine and proposes a concept that involves reforming the bodies of advocacy self-governance, ensuring effective disciplinary responsibility of advocates, strengthening the role of advocates in human rights protection activities, as well as raising the level of professional skill of advocates. The main directions for improving the organizational foundations of the legal profession in Ukraine have been determined, namely: strengthening the role of legal self-government, improving the quality of education and professional training of lawyers, expanding the scope of providing legal services, ensuring effective control over the activities of lawyers, and the development and implementation of new technologies and information systems in the work of lawyers. It was concluded that improving the organizational foundations of the legal profession in Ukraine is an important task that requires a comprehensive approach and joint work of all interested parties, including state and public organizations. The implementation of the above directions will allow to increase the level of public trust in the profession of lawyer, ensure the high quality of legal services and contribute to the development of democracy and the rule of law in Ukraine.
В статье рассмотрены проблемы, которые существуют в организации адвокатуры в Украине и предложена концепция, предусматривающая реформирование органов адвокатского самоуправления, обеспечение эффективной дисциплинарной ответственности адвокатов, усиление роли адвокатов в правозащитной деятельности, а также повышение уровня профессионального мастерства адвокатов. Определены основные направления совершенствования организационных основ адвокатуры в Украине, а именно: усиление роли адвокатского самоуправления, повышение качества образования и профессиональной подготовки адвокатов, расширение возможностей предоставления юридических услуг, обеспечение эффективного контроля за деятельностью адвокатов и разработка и внедрение новых технологий информационных систем в работе адвокатов.
