Анотація
У статті проаналізовані основні підходи до формулювання
поняття «соціально-правовий механізм протидії злочинності»
і обґрунтовано можливість його застосування у кримінологічних дослідженнях.
This article is focused on the analysis of the main approaches to the formulation of the concept of “social and legal mechanism for combating crime” and on substantiation of its application in criminological research. The importance of the analysis of the phenomenon of social and legal mechanism for combating crime is primarily determined by the fact that criminological theory develops regulations that may be useful for various sciences that affect the interests of combating crime area. It mostly concerns the sciences of criminal, criminal and procedural, penal law. This is due to the fact that the formation of a rule of law state, as a mandatory component, includes the creation of a modern legal system that meets the idea of social justice and based on generally accepted legal principles and norms. Effective combating crime causes the exclusion of legal nihilism and the possibility to adopt such laws and regulations that contradict the objective patterns of the society’s development. Besides, the study of the mentioned mechanism assists in elaboration of optimal practical solutions and the formation of scientifically based ways of combating crime. Their nature is directly driven by the essence and content of basic activities. Taking into account everything mentioned before, the authors have offered such a definition of this category as an integrated holistic totality of necessary and sufficient elements, by the help of which the subject forms the rational system of influence on the factors and determinants of crime, ensures effective implementation of criminological process, thus, achieving effective performance of the tasks and functions, assigned to the system of combating crime. Herewith, mentioned comprehensive organizational and legal phenomenon, aimed at improvement of the system of combating crime, includes a set of organically connected and interacting elements (subjective composition, objective, tasks, principles, functions, methods, legal basis of the activities, etc.). The stated mechanism is a derived category from the system of combating crime as a social phenomenon and is a mean of expressing its practical potential. From mechanistic positions, the mechanism of combating crime is the internal construction (a form of organization) of criminological activities, mechanics of transmitting the ideas contained in the legal awareness, into real social practice.
В статье проанализированы основные подходы к формулировке понятия «социально-правовой механизм противодействия преступности» и обоснована возможность его применения в криминологических исследованиях.
