Анотація
У дисертації розроблено наукові основи, загальні методичні і
організаційні положення судової телекомунікаційної експертизи.
Визначено поняття телекомунікаційної експертизи, досліджено її місце в
системі судових експертиз і проаналізовано значення у кримінальному
провадженні. Систематизовано об’єкти судової телекомунікаційної
експертизи, окреслено предмет та запропоновано перелік завдань цієї
експертизи. Розглянуто систему методів і засобів діагностичних та
ідентифікаційних досліджень у рамках судової телекомунікаційної
експертизи. Виявлено особливості тактики призначення та проведення
судової телекомунікаційної експертизи під час розслідування злочинів, а
також надано науково обґрунтовані рекомендації щодо використання її
результатів у кримінальному провадженні.
The thesis theoretically generalizes out and suggests a new solution of the scientific problem, which was manifested in the development of scientific foundations, general methodological and organizational provisions of the judicial telecommunications expertise. The concept of the telecommunications expertise was defined, its place in the system of forensic examinations was investigated and its significance in criminal proceedings was analyzed. The definition of the generic and direct items of the judicial telecommunications expertise was proposed. Classifications of the items of the judicial telecommunications expertise, in accordance with such criteria as their nature, the generally recognized separation of computer technology and the procedural status, were formulated. The subject of the judicial telecommunications expertise as a scientific category as well as the sphere of its practical activity was determined. The list of tasks of the forensic telecommunications expertise in accordance with the distribution of its items into hardware, information and software was proposed. The methods used in the forensic telecommunications expert studies accordingly to the developed classification, which distinguishes such three groups as general scientific, private and special, were considered. The particular attention was paid to the special methods, which are to solve the problems that are specific for the telecommunications expertise. It was ascertained that at present there are no well-known developed special methods for carrying out the telecommunications expertise, and there is only one specially developed methodology. The sources for the development of new methods using such special methods as the main provisions of forensic expert science and methodological achievements of related expertise, the main of which is the computer-technical expertise were proposed. The provisions of the diagnostic research methodology, the main one of which is the determination of the technical state of the researching item which is given special attention in the forensic telecommunications expertise, were generalized. In accordance with the specificity of the type of the expertise under examinations, the process of expert and forensics identification at each stage of its examination was considered in details. The specificity of the appointment and conduct tactics of the judicial telecommunications expertise in investigating crimes accordingly to the situational approach was revealed. The tactical specificity of investigative actions conduction, during which the most frequently appeared such items for the telecommunications expertise as inspection and search, were considered. The requirements for each part of the forensic telecommunications expertise conclusion, which must be observed while drafting it, were elaborated. The scientifically substantiated recommendations on the evaluation of the forensic telecommunications expertise conclusion and the use of its results in criminal proceedings were provided.
В диссертации разработаны научные основы, общие методические и организационные положения судебной телекоммуникационной экспертизы. Определено понятие телекоммуникационной экспертизы, исследовано ее место в системе судебных экспертиз и проанализировано значение в уголовном производстве. Систематизированы объекты судебной телекоммуникационной экспертизы, определен предмет и предложен перечень задач этой экспертизы. Рассмотрена система методов и средств диагностических и идентификационных исследований в рамках судебной телекоммуникационной экспертизы. Выявлены особенности тактики назначения и проведения судебной телекоммуникационной экспертизы при расследовании преступлений, а также предоставлены научно обоснованные рекомендации по использованию ее результатов в уголовном производстве.
