Анотація
Розглянуто основні підходи до закріплення суспільного ладу в конституціях пострадянських
держав. Зроблено висновок, що конституційне регулювання суспільних відносин у різних країнах неоднакове за формою і обсягом.
The article’s objective is to study basic approaches of constitutional consolidation of social system in post-Soviet countries. It is noted that the state affects the social system, primarily through legal regulation of social relations – establishing or sanctioning of legal norms and guaranteeing their implementation. Legal regulation in today’s democratically organized society is based on the Constitution and other sources of law having constitutional value. The social system in the constitutional state definitely gets more or less complete consolidation and guarantee at the Constitution level as the basic law. The author of the article analyzes the content of constitutions of post-Soviet countries, which formalize the concept of «the basis of constitutional system». Analysis of the content of relevant sections has revealed that their rules regulate social relations associated with the organization of social system. Besides, the rules that regulate the principles of social system, are contained in the articles on regulation of higher authorities, the legal status of a man and citizen. As a result, it is stated that constitutional consolidation of social relations in post-Soviet countries is carried out differently, both in form and in volume. In the vast majority of countries’ constitutions the norms concerning the foundations of society, are grouped in one section. However, in some countries the relevant rules have found consolidation in the sections devoted to both the system of state authorities and in the sections, which determine the basis of the legal status of a person. Besides, analysis of the constitutional texts of post-Soviet states testifies the expansion of the foundations’ list of constitutional system and their coming in the content to the countries with developed democracy
Рассмотрены основные подходы закрепления общественного строя в конституциях постсоветских государств. Сделан вывод, что конституционное регулирование общественных отношений в разных странах неодинаково по форме и объёму.
