Анотація
На підставі аналізу наукової літератури та практики органів досудового
слідства розглянуто деякі особливості використання спеціальних медичних знань
при розслідуванні злочинів проти авторитету органів державної влади у сфері
правоохоронної діяльності.
Today investigative practice is not given enough attention to the role of forensic expertise to determine many factors when investigating crimes against the authority of public authorities in the field of law enforcement. Forensic capabilities as a specialist, not used during the investigation of these crimes. For example, when assigning forensic examinations there is a partial list of questions that ask to address forensics, mistakes in formulating questions as conclusion - the investigator does not use the full capabilities of forensic investigations. The successful investigation of crimes against the authority of public authorities in the field of law enforcement, where there is encroachment on the life and health of a law enforcement officer - murder, causing bodily harm and other offenses, possible only in case of proper use, namely, forensic expertise. Thus, it is necessary based on the analysis of scientific literature and practice of pre-trial review features the use of special medical knowledge in the investigation of crimes against the credibility of public authorities in the field of law enforcement. So when it comes to attacks on life and health, law enforcement officials or members of their families, investigating sure to engage and collaborate with the medical examiner. Firstly relevance of this action is that the expert during the investigation (search) actions should help the representative of investigators to find evidence of a crime (biological - blood, hair, etc.), various objects (loop weapons - evidence) and remove them without damage. In - Second, given the specificity of the investigation of this category of criminal proceedings on the remote to assign legal expertise (forensic examination, medical and forensic examination, etc.). Therefore, the accuracy of the investigation (search) action on the completeness and literacy issues raised at solving expert, it depends on the correctness of the conclusion and hence the completeness and legality of the investigation of the criminal proceedings. Thus, there is no doubt the importance of use in investigating crimes against the authority of state authorities in law enforcement special medical knowledge. It should be remembered that the possibility given special kind of knowledge can be used not only in the process of forensic examination, but also that important during the preparation and conduct of the investigative (detective) action.
