Анотація
На підставі аналізу наукової літератури та практики органів досудового
слідства запропоновано слідчі ситуації початкового етапу розслідування посягань
на життя працівника правоохоронного органу та визначено послідовність
відповідних слідчих дій.
Based on the analysis of scientific literature and practice of pre-trial investigation bodies, investigative situations of the initial stage of the investigation of encroachments on the life of the law enforcement officer were proposed and a sequence of relevant investigative actions was determined. The purpose of investigating any crime is to establish the truth in a criminal proceeding. The achievement of this goal is only possible if the investigator timely chooses the best way of knowing the crime on the basis of the information that he will have at the initial stage of the investigation. In this regard, in practice, investigators are often confronted with difficulties, this is due to the lack of relevant experience in many employees of the pre-trial investigation bodies, and with the imperfection of existing scientific-practical forensic recommendations. Therefore, successful disclosure and investigation of crimes, including encroachments on the life of a law enforcement officer (Article 348 of the Criminal Code of Ukraine), which are categorized as serious crimes, to a large extent depends on the ability of the person conducting the investigation to properly evaluate and solve investigating situation, based on information available to her. Thus, for the initial stage of the investigation of encroachments on the life of a law enforcement officer, typical follow-up situations are typical: 1) the assault on the life of the law enforcement officer is committed, the offender is detained at the crime scene, or immediately after his commission; 2) the assault on the life of the law enforcement officer committed, the offender disappeared from the scene, but there is indicative information about the person who committed the crime, which allows only to suspect a person in the commission of the offense; 3) an attack on the life of the law enforcement officer committed, the offender disappeared from the scene, the data on him missing. So, depending on the investigative situations that occur at the initial stage of the investigation of the encroachments on the life of the law enforcement officer, the investigator must be the most rational and effective system of actions, that is, the situation not only should determine the range of primary investigative actions, but their sequence - the program of actions of the investigator. It should be noted that the development of the problem of the investigative situation has a specific practical purpose and should be reduced to determining the typical situation, which allows to develop recommendations on the methodology for investigating encroachments on the life of the law enforcement officer at one or another stage.
