Анотація
В статті досліджено проблемні питання, що виникають під час реалізації основних функцій та завдань місцевого самоврядування України, та здійснено пошук можливих шляхів їх розв’язання на сучасному етапі децентралізації влади. Визначено, що метою реформування місцевого самоврядування на сьогоднішній день, має стати забезпечення його здатності самостійно вирішувати питання місцевого значення за рахунок власних коштів, тобто територіальні громади повинні бути наділені більшими ресурсами, внутрішніми резервами для виконання завдань та функцій, що покладені на них діючим законодавством щодо вирішення питань місцевого значення.
The article deals with the problems that arise during the implementation of the main functions and tasks of local self-government of Ukraine, and the search for possible ways of their solution at the present stage of the decentralization of power. Decentralization should be understood as the transfer of powers and related resources (in particular, budget revenues) from the state to local self-government bodies. In the conditions of the reform of local self-government and territorial organization of power, changes are taking place regarding the distribution of powers of state administration bodies of various levels and local governments. Countries that have ratified the European Charter of Local Self-Government must adhere to the "subsidiarity principle", which states that the exercise of authority should be carried out as close to the real life of citizens. The analysis of Ukrainian legislation on local self-government shows that in determining the competence of local self-government, the principle of subsidiarity was not fully respected. Consequently, a significant part of the local self-government powers was given the status of "delegated", and the nature of the division of powers between local authorities and local executive authorities led to the emergence of "competency of competence" when the same powers were assigned to various public authorities . In the time of independence in Ukraine, the constitutional foundations of local self-government have been laid down, the European Charter of Local Self-Government has been ratified, a number of basic legal acts have been adopted that create legal and financial bases for the activities of local self-government bodies. However, still the system of local self-government does not meet the needs of society at the required level. The functioning of local self-government bodies in most of the territorial communities does not ensure the creation and maintenance of a favorable living environment necessary for the full development of the person, its self-realization, the protection of its rights, providing local governments with the institutions and organizations created by them, high-quality and accessible administrative, social and other services. in the respective territories. The author states that the goal of reforming local self-government to date is to ensure its ability to independently solve local issues at its own expense, that is, territorial communities should be allocated with more resources, internal reserves for the tasks and functions entrusted to them by the current legislation on solving local issues.
В статье рассмотрены проблемные вопросы, возникающие при реализации основных функций и задач местного самоуправления Украины, и осуществлен поиск возможных путей их решения на современном этапе децентрализации власти.
