Анотація
Здійснено аналіз наукового доробку вчених-правознавців Дерптської історико-правової
школи щодо розробки методології історико-правової науки, вивчення питань виникнення
держави та її становлення у східних слов’ян, викладання правових дисциплін на початку
ХІХ ст.
The article defines Dorpat historical and law school. This is a group of scientists united by common methodological approach, scientific problems concerning the study of State and Law of Old Russia and educational activities place, which was formed in Dorpat University at the beginning of the nineteenth century. The authors propose to introduce this concept into historical and legal science. The reasons for the emergence of this school and the role of Dorpat University in its formation were justified. It was focused on the scientific activities of the three main representatives of this school: Johann Georg Neumann (1780–1855), Johann Philipp Gustav von Evers (1781–1831), Alexander Magnus Fromhold von Reutz (1799–1862 ). The ancestor of this school was Neumann, and the most prominent representative was Evers. Neumann played a major role in the spread of new historical and dogmatic methodology in the Russian historical and legal science, developed the principles, defined the basic content and methods of teaching law subjects. Evers proposed a new periodization of national history, formulated the theory of tribal living, presented new arguments regarding the antinormanist theory, produced a series of case studies on History of Russia. His work greatly influenced the research of such prominent historians of the nineteenth century as M. M. Karamzin and S. V. Solovyov. Evers was an excellent lecturer and contributed significantly to the study of history of law in the Russian Empire. We considered the main stages of the research activities of Reutz, its contribution to the development of various aspects of the history and law of Kievan Rus, in the theory of tribal living, his views on the polity, the judiciary and the law proceedings of Kievan Rus.
Осуществлён анализ научной наработки учёных-правоведов Дерптской историко-правовой школы относительно разработки методологии историко-правовой науки, изучения вопросов возникновения государства и его становления у восточных славян, преподавания правовых дисциплин в начале ХІХ в.
