Анотація
Розкрито сутність філософсько-релігійного розуміння правовідносин
як складного соціального явища, яке можна вважати елементом релігійної
системи, оскільки певна частина цих суспільних відносин регулюється сукупністю внутрішньо узгоджених і взаємопов’язаних релігійних норм (приписів).
Окреслено релігійні правовідносини як специфічний вид суспільних відносин,
об’єднаних у певну внутрішньо узгоджену, історично сформовану систему
(діяльність релігійних організацій, життєдіяльність віруючих, релігійна
свідомість тощо).
The article is devoted to the disclosure of the essence of the philosophical and religious understanding of legal relations as a complex social phenomenon, which can be considered a structural element of the religious system, since a certain part of these social relations is regulated by a set of internally agreed and interrelated religious norms (prescriptions). This is a religious relationship as a specific type of social relations, united in a certain internally agreed, historically formed system (the activity of religious organizations, the vital functions of believers, religious consciousness, etc.). The existential essence of religion as a normative and regulatory system is determined by its social functions – cognitive (religion – this is, first of all, the field of knowledge); value and ideological (in the framework of any religious system is necessarily determined, which is definitely useful in the relations of people in the material and in the spiritual aspect, the defined standards of the positive are necessarily fixed, sacralized and versatilely supported as a prerequisite for the stable existence of society); a function of social calming (the person removes a heavy mental burden of unnecessary doubts as to how she values the world in which she lives, what and how she does in it); regulatory function (the last summarizes the action of all previous ones, integrates them into a single concrete social result, within the framework of this function, the individual being of believers and their social relations are organized on the basis of a single value and world-view foundation and the perception of the standards of mutual behavior). Despite the fact that law and religion have certain features of similarity, they are different social regulators, because they have obvious peculiarity and can significantly dissonant one in reference to another. In this case, it is mainly about the contradictions of the doctrinal nature, that’s why the practical interaction and practical contradictions of religious and legal regulators in society should be considered differently in each individual case, according to a certain point in time, a certain place in the social space and in the context of a certain obvious situation.
