Правові засади визначення завдань і принципів фінансового захисту військовослужбовців в Україні

Abstract

Визначено коло завдань та принципів фінансового захисту військовослужбовців як настанов правового регулювання цього захисту, що має особливе значення в умовах запровадження воєнного стану в наслідок російської агресії. Зазначено, що фінансовий захист військовослужбовців можна вважати одним з основних факторів, що впливає на ефективність військової служби. Встановлено, що завданнями фінансового забезпечення військовослужбовців є основні соціально-економічні напрямки його впливу на ефективність військової служби. До таких завдань віднесено: задоволення багатоаспектних життєвих потреб військовослужбовців на високому рівні, який відповідає суспільним очікуванням від якості реалізації такої служби; підкреслення соціальної значущості військової служби; компенсація військовослужбовцям ризикованості виконання ними своїх службових обов’язків. Доведено, що принципи являють собою основоположні засади, які лежать в основі фінансового забезпечення військовослужбовців, та визначаються низкою нормативно-правових актів різної юридичної сили.Currently, an urgent consideration is the assessment of the needs and requirements of military personnel regarding their financial protection, including issues related to their income, social guarantees, and financial wellbeing during military service. It is essential to determine the legal foundations and regulatory laws governing the financial protection of military personnel in Ukraine, as well as to define the tasks and principles that form the basis of their financial protection. The purpose of this article is to delineate the scope of tasks and principles for the financial protection of military personnel as guidelines for legal regulation, which holds particular significance in conditions of the introduction of a state of war due to Russian aggression. Used methods: normative-legal analysis for the study of current legislation and norms regulating the financial protection of servicemen in Ukraine; comparative analysis regarding the financial protection of servicemen to identify advanced approaches and potential improvements; documentary analysis - for the examination of official documents, decisions, and resolutions related to the financial protection of servicemen and their role in the defense system. Results. Ukraine has a negative experience of the 1990s, when the reduction of financial support for the social needs of servicemen had a negative impact on the devaluation of military service and, as a result, a devastating impact on the combat effectiveness of the Armed Forces as a whole. It is emphasized that the tasks and principles reveal the main characteristics and determine the role of financial protection of military personnel as an important element of the national security mechanism. Conclusions. It was established that the tasks of financial support of military personnel are the main socioeconomic directions of its influence on the effectiveness of military service. These tasks include: meeting the multifaceted life needs of servicemen at a high level that meets public expectations of the quality of such service; emphasizing the social significance of military service; compensation to servicemen for the riskiness of their duties. It has been proven that the principles represent the fundamental principles that underlie the financial support of military personnel, and are defined by a number of regulatory and legal acts of different legal force. The following principles are highlighted: constitutional, general legal, branch (first, financial and legal and principles of social protection), as well as specific principles of financial protection of military personnel. The latter include the following: transparency of sources of financial protection of military personnel; exclusively legislative definition of the types, scope and sources of financial protection of military personnel; compliance of financial protection with the degree of risk of military service; a decent level of financial protection of servicemen and family members of servicemen who lost their lives or health in connection with military service.Определены задачи и принципы, определяющие направленность содержания финансовой защиты военнослужащих на правовых основаниях. Новизна заключается в углубленном понимании современных задач и принципов финансовой защиты военнослужащих на основании действующего отечественного законодательства, открытии новых знаний и инсайтов в области финансовой защиты военнослужащих. Дана характеристика роли финансовой защиты военнослужащих в современных условиях и определены виды принципов, лежащих в основе ее реализации, опираясь на действующее законодательство.
