Загальноправові та спеціальні принципи взаємодії Національної поліції з іншими суб’єктами сектору безпеки і оборони України

Abstract

Забезпечення ефективної взаємодії Національної поліції з іншими суб’єктами сектору безпеки та оборони України потребує системного осмислення загальноправових і спеціальних принципів, що визначають допустимі межі, форми та методи спільних дій, гарантують дотримання прав людини, верховенства права й законності. Мета – з’ясування сутності та структури загальноправових і спеціальних принципів взаємодії Національної поліції з іншими суб’єктами сектору безпеки і оборони України. Методи. Застосовано аналіз і синтез для виявлення сутності принципів та їх функцій; системно-структурний метод – для визначення взаємозв’язку між загальноправовими та спеціальними засадами; порівняльно-правовий метод – для зіставлення національних підходів з міжнародними стандартами; формально-юридичний метод – для інтерпретації норм Конституції та законодавства щодо взаємодії сектору безпеки. Результати. Встановлено, що ключовими загальноправовими принципами є верховенство права, законність, людиноцентризм, рівність і недискримінація, справедливість, які унеможливлюють свавілля, забезпечують пропорційність втручань і стандартизацію процедур. Спеціальні принципи – пріоритет превентивного впливу, безперервна готовність, єдність мети та узгодженість дій, адекватність і співмірність – конкретизують вимоги до спільних управлінських рішень, ресурсного забезпечення та контролю правомірності дій у сфері національної безпеки. Висновки. Загальноправові й спеціальні принципи виконують системоутворюючу та регулятивну функцію у взаємодії Національної поліції з іншими суб’єктами сектору безпеки й оборони, формуючи правові орієнтири для нормативного забезпечення, запобігання правопорушенням і гарантування прав та свобод людини в умовах сучасних безпекових викликів.

Ensuring effective interaction of the National Police with other actors in Ukraine’s security and defense sector requires a systematic understanding of general legal and specialized principles that define permissible boundaries, forms, and methods of joint actions, while guaranteeing respect for human rights, the rule of law, and legality. Purpose. To clarify the essence and structure of general legal and specialized principles governing the interaction of the National Police with other actors in the security and defense sector of Ukraine. Methods. Analysis and synthesis were applied to identify the essence and functions of the principles; the system-structural method was used to determine the interrelationship between general legal and specialized principles; the comparative-legal method was employed to compare national approaches with international standards; the formal-legal method was used to interpret the provisions of the Constitution and legislation regarding the interaction of the security sector. Results. It was established that the key general legal principles are the rule of law, legality, human-centeredness, equality and non-discrimination, and justice, which prevent arbitrariness, ensure proportionality of interventions, and standardize procedures. Specialized principles – priority of preventive impact, continuous readness, and unity of purpose and coherence of actions, adequacy, and proportionality – specify the requirements for joint administrative decisions, resource provision, and control over the legality of actions in the field of national security. Conclusions. General legal and specialized principles perform a system-forming and regulatory function in the interaction of the National Police with other actors in the security and defense sector, forming legal guidelines for regulatory support, preventing violations, and ensuring human rights and freedoms in the context of contemporary security challenges.
