Формування професійної компетентності майбутніх юристів у процесі фахової підготовки

Abstract

Уточнено змістовно-структурні характеристики професійної компетентності юристів і її формування в умовах фахової підготовки. Доведено доцільність ідеології та методології компетентнісного підходу до організації процесу фахової підготовки юристів. Визначено сутність професійної компетентності юристів. Розглянуто критерії і показники рівнів сформованості професійної компетентності юристів.

In the article actuality of the competency approach is well-proven near professional preparation of future lawyers. After competency approach basis of professional activity on government service is not only totality of fundamental knowledge that were purchased in establishment of higher education and is academic on the maintenance and character but also ability to carry out social and professional roles that answer post status. The key categories of competency approach are a competense and competence, that express a normative educational result and personality-professional description, that integrate motivational-valued, cognitive-activity, personality-behavior components. Accordingly a competent specialist has a circle of duties, plenary powers and rights. Taking into account the conclusions of scientists professional competence of lawyer of will define as totality of mutually constrained motivational axiology, informatively-gnostic, activity-behavioral and personality-reflective components. Normatively-legal and scientifically-methodical bases of forming of constituents of professional competence of future lawyers are certain. Thus, the formation of the motivational and axiological component involves awareness of the moral and ethical content of laws and subordinate legal acts, a valuable attitude towards them, the supremacy and value of law in all spheres of social life, humanistic life attitudes, interest in law enforcement activities. The information-gnostic component is formed by awareness in the field of jurisprudence, the presence of legal knowledge, which is the basis of the formation of legal awareness and legal thinking, the normative basis of lawful activity, mastering the methods of law enforcement activity. The prerequisite for the development of the information-gnostic components of the professional competence of a lawyer is the study of legal disciplines, the main of which are the theory of the state and law, the history of the state and law of the foreign countries, history of the state and law of Ukraine, constitutional, administrative, criminal, civil, family, labor, environment, agrarian, financial, banking, tax, international law. The activity-behavioral component of a lawyer’s professional competence involves the formation of a group of skills: cognitive, operational-regulatory, organizational-communication, research-investigate skills. The personal-reflective component of a lawyer’s professional competence means the formation of personal qualities, namely: humanism, citizenship, honesty, dignity, responsibility, tolerance, tact, benevolence, sociability, discipline, will, the ability to self-control knowledge, selfanalysis, self-control, defending one’s own opinion, choosing persuasive arguments, adequate self-assessment of their law enforcement action. According to the structure of the professional competence of lawyers, a criterion base for measuring the levels of formation of professional competence of lawyers has been determined, namely: motivational, cognitive, activity, personal criteria with corresponding indicators. The issue of selecting diagnostic tools for measuring the levels of formation of professional competence of lawyers is promising.

Уточнены содержательно-структурные характеристики профессиональной компетентности юристов и ее формирование в условиях профессиональной подготовки. Доказана целесообразность идеологии и методологии компетентностного подхода к организации процесса профессиональной подготовки юристов. Определена сущность профессиональной компетентности юристов. Рассмотрены критерии и показатели уровней сформированности профессиональной компетентности юристов.
