Проблемні питання забезпечення повноважень слідчого судді під час досудового розслідування при воєнному стані та у повоєнній перспективі

Abstract

У статті на ретроспективному рівні здійснено дослідження теоретичних, законодавчих, правозастосовних наявних проблемних питань щодо забезпечення слідчим суддею прав, свобод та законних інтересів людини і громадянина на досудовому розслідуванні, з урахуванням змін і доповнень внесених законодавцем відносно його повноважень, пов’язаних з військовою агресією України, що визначає його діяльність й у повоєнній перспективі. На підставі вказаного констатовано на тому, що частина повноважень слідчого судді тимчасово на період воєнного часу наділено й скеровано прокурору у разі неможливості виконання у випадках чітко визначених у законі певних повноважень слідчим суддею. З вказаних проблемних питань досліджено наукові позиції вчених і представників національних наукових шкіл, а по актуальним і перспективним проблемним питанням сформовано наукові позиції авторів. За результатами проведеного дослідження надано пропозиції і рекомендації з теоретичних, організаційних, процесуальних, законодавчих та інших проблемних питань та шляхів їх вирішення.

The article retrospectively examines the theoretical, legislative and law enforcement issues related to ensuring by an investigating judge of the rights, freedoms and legitimate interests of a person and a citizen during pre-trial investigation, with due regard to the amendments and additions made by the legislator to his/her powers related to the military aggression against Ukraine, which determines his/her activities in the post-war perspective. Based on the above, it is noted that some of the powers of the investigating judge are temporarily vested in the prosecutor for the period of wartime and are delegated to the prosecutor in case of impossibility to exercise certain powers of the investigating judge in cases clearly defined by law. The scientific positions of scientists and representatives of national scientific schools were studied on these problematic issues, and the scientific positions on current and promising problematic issues were formed. Based on the results of the study, it was provided suggestions and recommendations on theoretical, organisational, procedural, legislative and other problematic issues and ways of their solution.
