Принципи і форми кадрового забезпечення Державної кримінально-виконавчої служби України та уповноважених органів з питань пробації

Abstract

Стаття присвячена з’ясуванню поняття та кола основних принципів, а також форм кадрового забезпечення Державної кримінально-виконавчої служби України та уповноважених органів з питань пробації. Наголошено, що чинне українське законодавство не містить повного переліку принципів і форм кадрового забезпечення пенітенціарної системи. Розглянуто дослідницькі позиції щодо розуміння поняття принципів і форм у сфері права, на підставі чого запропоноване авторське визначення поняття принципів кадрового забезпечення ДКВС України та уповноважених органів з питань пробації. Викладене власне бачення кола основних принципів і форм досліджуваного забезпечення.The article is devoted to clarifying the concept and range of basic principles, as well as forms of personnel support of the State Criminal and Executive Service of Ukraine and authorized bodies on probation issues. In this regard, research approaches to understanding the essential content of principles and forms, as well as their place and role in the mechanism of legal regulation, are considered. On the basis of the conducted analysis, the author's definition of the concept of the principles of staffing of the State Criminal and Executive Service of Ukraine and authorized bodies on probation issues is proposed. In the opinion of the author, the key properties characterizing the nature and significance of these principles are highlighted. It is emphasized that the current Ukrainian legislation does not contain a complete list of principles and forms of staffing of the penitentiary system. The list of general, sectoral and special principles, which, in the opinion of the author, should be the basis of the researched personnel support is given. The content and meaning of special principles are revealed. The main forms of personnel support of the penitentiary system of Ukraine, which are related to the implementation of rule-making, law enforcement, personnel, organizational and staffing and educational work, are highlighted. It is noted that today in our country, at the legislative level, mainly general and branch principles are established, which also concern the staffing of the State Criminal and Executive Service of Ukraine and authorized probation bodies, but they do not reflect the specific principles of this provision. In order to improve the quality of personnel support of the State Criminal and Executive Service of Ukraine and authorized bodies on probation issues, it is advisable to develop a strategy for its implementation, in which special attention will be paid to the principles and forms that reflect the key ideas underlying the mechanism of this support, as well as methods of practical detection in the the objective validity of organizational and legal, managerial, educational, scientific and methodical and other personnel support measures.Статья посвящена выяснению понятия и круга основных принципов, а также форм кадрового обеспечения Государственной уголовно-исполнительной службы Украины и уполномоченных органов по пробации. Отмечено, что действующее украинское законодательство не содержит полного перечня принципов и форм кадрового обеспечения пенитенциарной системы. Рассмотрены исследовательские позиции по пониманию понятия принципов и форм в сфере права, на основании чего предложено авторское определение понятия принципов кадрового обеспечения ГУИС Украины и уполномоченных органов по пробации. Изложено собственное видение круга основных принципов и форм исследуемого обеспечения.
