Підготовка майбутніх юристів до консультативної діяльності в аудиторній роботі

Abstract

Розкрито нормативно-законодавчі фактори юридичної освіти, які впливають на навчальну підготовку студентів до консультативної діяльності. Визначено відсутність спеціальних дисциплін консультативного спрямування у циклах гуманітарної, соціально-економічної та природничо-наукової, професійної (професійноорієнтованої) та практичної підготовки у нормативній частині навчальних планів. Охарактеризовано засоби підготовки студентів до консультативної діяльності у процесі вивчення юридичної деонтології. Здійснено аналіз досвіду консультативної підготовки майбутніх юристів у процесі вивчення фахових дисциплін з нотаріальної та суддівської праці.The article deals with the legislative and regulatory factors of legal education, affecting the students training for the advisory work. The analysis of the educational programs for law students has showed that there are no special advisory disciplines in the cycles of humanitarian, socio-economic and natural sciences, professional (vocationaloriented) and practical training in the normative part of the curriculum. The curricula are not given enough attention to the important disciplines which are not related to the direct application of the law kinds of professional lawyers’ work such as business communication, tactics, constructive analysis and modeling of the situations, etc. The curricula do not take into account the practical needs for training in the specific areas of practice. The characterized means of the students training for advisory work in the study of legal deontology can help the students to find the information about nature and objectives closely related to the economic and industrial relations of the legal advisers at the enterprises, institutions, organizations, associations, the private firms, interstate associations. The acquaintance with the managerial and organizational work on the project of preparation and clearance documents, checking the reliability of financial clients, customers, partners and crime prevention in the production and organization of preventive measures are also given. The author describes the ways of conducting agitation and crime preventive work in order to represent and protect the interests of the organization in the other organs or institutions, ensuring internal and external security of the organization. The analysis of the future lawyers’ counseling training experience in the process of studying vocational subjects at the notary and judicial work, which reveals some of the professional proper training of future lawyers’ characteristics, such as the similarities and differences of interviewing and counseling, goals and main stages of the counseling, psychological types and characteristics of client’s legal examination as a rational dialogue, specific questions during the interview, psychological methods of persuasion in the process of consultation has been made by the author.Раскрыты нормативно-законодательные факторы юридического образования, влияющие на учебную подготовку студентов к консультативной деятельности. Определено отсутствие специальных дисциплин консультативного направления в циклах гуманитарной, социально-экономической и научно-научной, профессиональной (профессионально-ориентированной) и практической подготовки в нормативной части учебных планов. Охарактеризованы средства подготовки студентов к консультативной деятельности в процессе изучения юридической деонтологии. Осуществлен анализ опыта консультативной подготовки будущих юристов в процессе изучения профессиональных дисциплин по нотариальному и судейскому труду.
