Тактичні особливості проведення огляду місця події під час розслідування сексуального насильства в умовах війни

Abstract

Обґрунтовано тактичні особливості проведення огляду місця події під час досудового розслідування випадків сексуального насильства в умовах війни задля покращення ефективності розслідування, забезпечення безпеки та захисту прав потерпілих, а також підготовки фахівців, які здійснюють розслідування в подібних умовах. Встановлено, що організаційнотактичними особливостями проведення огляду місця сексуального насильства в умовах війни є: визначення функціонального призначення кожного члена слідчо-оперативної групи з метою дотримання планомірності, повноти та об’єктивності огляду місця події; реалізація безпекової складової роботи слідчо-оперативної групи у випадках проведення огляду місця події неподалік лінії розмежування вогневого зіткнення або на деокупованих територіях України; проведення рекогносцировки місцевості; пошук та фіксація джерел цифрової інформації про окремі обставини вчинення злочину; дослідження речової обстановки на предмет наявності слідів злочину, що прямо чи опосередковано вказують на особу злочинця та ін.

The crime scene examination is not only a key but also a highly informative component of investigative (search) measures during the investigation of crimes of various kinds, categories, and types. This is particularly determined by its practical significance, as it provides authorized individuals of the pre-trial investigation body with the opportunity for direct perception of the surrounding environment at the scene of the incident. The changes taking place allow for the identification, fixation, and extraction of elements of the evidentiary picture. In the case of sexual crimes, special attention is paid to objects that may contain traces of the perpetrator's hands and traces of biological origin, such as bodily fluids. The process of examination proves to be resource-intensive in terms of organizational measures, involvement of specialists with specific knowledge, forensic equipment, the use of tactical methods, and procedural documentation of the obtained results. The purpose of the article is to justify the tactical features of conducting a crime scene examination during the pre-trial investigation of cases of sexual violence in wartime to enhance the effectiveness of the investigation, ensure the safety and protection of victims' rights, and prepare professionals conducting investigations in similar conditions. The applied research methods include the systemic method for examining the system of laws and procedures related to the investigation of sexual violence in wartime and their impact on the effectiveness of justice; the comparative method is used to compare practices of crime scene examinations and pre-trial investigation of sexual violence in wartime in different countries. The results encompass the definition and justification of effective tactical techniques and strategies for conducting crime scene examinations of sexual violence in wartime; disclosure and systematization of evidence collection methods aimed at identifying traces of the perpetrator's hands and biological evidence, including bodily fluids; analysis of the interaction between the procedural documentation of examination results and pre-trial investigation and the possibility of their use in court proceedings. It is shown that conducting a crime scene examination during the investigation of sexual violence in wartime should adhere to certain principles that determine the completeness and sufficiency of the information obtained, namely: urgency and promptness; safety; singularity; legality; systematic and objectivity. Conclusions. It has been established that the organizational and tactical features of conducting a crime scene examination of sexual violence in wartime include: defining the functional purpose of each member of the investigative-operational group to ensure systematic, comprehensive, and objective examination of the crime scene; implementing the safety component of the work of the investigative-operational group in cases of examining the crime scene near the line of fire or in de-occupied territories of Ukraine; conducting reconnaissance of the area; searching and documenting sources of digital information about specific circumstances of the crime; investigating the physical environment for evidence that directly or indirectly points to the identity of the perpetrator, etc.

Обоснованы тактические особенности проведения осмотра места происшествия во время досудебного расследования случаев сексуального насилия в условиях войны для улучшения эффективности расследования, обеспечения безопасности и защиты прав потерпевших, а также подготовки специалистов, осуществляющих расследование в подобных условиях. Установлено, что организационно-тактическими особенностями проведения осмотра места сексуального насилия в условиях войны являются: определение функционального назначения каждого члена следственно-оперативной группы с целью соблюдения планомерности, полноты и объективности осмотра места происшествия; реализация безопасной составляющей работы следственно-оперативной группы в случаях проведения осмотра места происшествия неподалеку от линии разграничения огневого столкновения или на деоккупированных территориях Украины; проведение рекогносцировки местности; поиск и фиксация источников цифровой информации об отдельных обстоятельствах совершения преступления; исследование вещной обстановки на предмет наличия следов преступления, прямо или косвенно указывающих на личность преступника и т.д.
