Сутність та особливості закладів вищої освіти зі специфічними умовами навчання як об’єкту адміністративно-правового регулювання

Abstract

У статті, спираючись на аналіз наукових поглядів вчених та норм чинного законодавства, запропоновано авторське визначення поняття закладів вищої освіти зі специфічними умовами навчання як об’єкта адміністративно-правового регулювання. Розкрито специфіку діяльності ЗВО зі специфічними умовами навчання. На прикладі Харківського національного університету внутрішніх справ надано характеристику сутності та змісту юридичного забезпечення ЗВО зі специфічними умовами навчання.

It was found that institutions of higher education with specific conditions of study as an object of administrative and legal regulation are educational institutions that are in the sphere of influence of the Ministry of Internal Affairs of Ukraine and carry out training and education of specialists in the field of law enforcement and related specialties. It was noted that these institutions have a specific status, and their activities are regulated not only by the norms of general legislation in the field of educational activity, but also by special departmental legal acts of the Ministry of Internal Affairs of Ukraine. It is emphasized that in the context of administrative and legal regulation studied in the article, it includes normative legal acts, procedures, standards and rules that relate to the organization, functioning, control and management of higher education institutions of the Ministry of Internal Affairs of Ukraine in order to ensure the quality of education, respect for rights and responsibilities of students and teachers, ensuring the safety and efficiency of the activities of these institutions. The features of higher education institutions as objects of administrative and legal regulation include the following: first, the specifics of the educational program; secondly, the corresponding ZVO are subject to administrative regulation, management and control by the Ministry of Internal Affairs; thirdly, the presence of special rules and requirements regarding cadet life, selfgovernment, etc. In addition, special rules of conduct and disciplinary responsibility are established for them; fourthly, the main purpose of the work of the studied higher education institutions is the training of specialists who will carry out official and labor activities in law enforcement agencies; fifth, subject not only to external, but also to internal control and supervision by the Ministry of Internal Affairs.

В статье, опираясь на анализ научных взглядов ученых и норм действующего законодательства, предложено авторское определение понятия заведений высшего образования со специфическими условиями обучение как объекту административно-правового регулирования. Раскрыта специфика деятельности ЗВО со специфическими условиями обучения. На примере Харьковского национального университета внутренних дел предоставлена ​​характеристика сущности и содержания юридического обеспечения ЗВО со специфическими условиями обучения.
