Принципи судочинства як найважливіші засади ефективної організації судової влади в Україні та країнах СНД

Abstract

Наведено основні принципи судової влади, керівні засади, що стосуються завдань, засобів та способів здійснення судочинства. За результатами порівняльного аналізу зроблено висновок, що принципи правосуддя в країнах СНД є тотожними та націленими на максимальне забезпечення дотримання прав людини і громадянина та інтересів держави.

The article deals with the principles of rule-making, forming the basis of the effective organization of judicial branch. The primary purpose of the research is the investigation and comparative analysis of the rule-making in Ukraine and CIS countries. It is scientific novelty that the author first in legal science held the comparative analysis of the rule-making in Ukraine and CIS countries, taking into account constitutional provisions, laws of Ukraine, international legislation, constitutions and legislation of CIS countries. The research creates science behind for the effective development of the judicial system of Ukraine. Current status of this problem in the scientific literature is analyzed. There is a wide range of ideas in relation to a concept «principles» in legal literature. The author points different approaches that are used for consideration of concepts «principle», «principles», «principles of rule-making». Having analyzed constitutional provisions of Ukraine and CIS countries, the author defined characteristics and principles of the judicial branch, that characterize its structure, organization and functioning. Principles of rule-making are characterized by regulatory character. On the basis of the research, the author states, that the principle of the execution of the judicial power by courts only, is one of the main and general principles for all countries. The research has a practical bearing on the further development of legal science, improvement of legislation that regulates organization and functioning of the judicial branch in Ukraine. The article may be helpful in education when teaching the course «Judicial branch in Ukraine and CIS countries». The article embodies the following provisions: the principles of rule-making are the major principles of effective organization of the judicial branch in Ukraine and CIS countries; principles of justice in CIS countries are identical and aimed at upholding human and civil rights and state interests; present principles of rule-making reveal that the judicial systems of CIS countries are meant to ensure independent, fair and impartial trial, as well as maintain all aspects of law.

Приведены основные принципы судебной власти, руководящие основы, касающиеся заданий и способов осуществления судопроизводства. По результатам сравнительного анализа сделан вывод, что принципы правосудия в странах СНГ являются тождественными и нацелены на максимальное обеспечение соблюдения прав человека, гражданина и интересов государства.
