Види суб’єктів юридичного забезпечення закладів вищої освіти зі специфічними умовами навчання

Abstract

У статті, спираючись на аналіз наукових поглядів вчених та норм чинного законодавства, окреслено коло суб’єктів юридичного забезпечення закладів вищої освіти зі специфічними умовами навчання. Відзначено, що кожен із окреслених у статті суб’єктів володіє своїм, особливим адміністративно-правовим статусом, який дозволяє їм організувати різні аспекти діяльності закладів вищої освіти зі специфічними умовами навчання.It is argued that in the context of the presented issues, the President of Ukraine: 1) appoints the leadership of individual higher education institutions, including those with specifi c conditions of study, which certainly affects their legal support and functioning as a whole; 2) has the right to develop bylaws, the norms of which are aimed at regulating the activities of higher education institutions; 3) acts as a representative of the state at the external level and can contribute to the development of international cooperation in the fi eld of education; 4) can develop state Strategies, Concepts, Programs, which are aimed at improving the activity of higher education institutions, including those with specifi c conditions of study; 5) exercises presidential control in the fi eld of education. It was established that the activities of the outlined higher bodies of state power (VRU of the President and CMU) are mainly aimed at the general legal support of higher education institutions with specifi c conditions of study, in particular: a) formation and implementation of state policy in the fi eld of education; b) the development of a legal framework, the norms of which are aimed at regulating the activities of higher education institutions in general, and higher education institutions with specifi c conditions of study, in particular; etc. It is summarized that the legal support of institutions of higher education with specifi c conditions of study is carried out with the help of a number of specially authorized subjects, which can be conventionally divided into three groups: 1) Higher bodies of state power (the Verkhovna Rada, the President of Ukraine and the CMU), whose activities are aimed at on the creation of general legal and organizational conditions for the functioning of the entire fi eld of education in general, and institutions of higher education (including those with specifi c conditions of study, in particular); 2) subjects directly responsible for ensuring the general aspects of the activities of higher education institutions with specifi c conditions of study (Ministry of Education and Ministry of Internal Affairs); 3) entities that directly implement legal support activities of higher educational institutions with specifi c training conditions, in particular, heads of higher education institutions and special departments (departments) of legal support. Each of the outlined subjects has its own, special administrative and legal status, which allows them to organize various aspects of higher education institutions with specifi c study conditions.В статье, опираясь на анализ научных взглядов ученых и норм действующего законодательства, очерчен круг субъектов юридического обеспечения заведений высшего образования со специфическими условиями обучения. Отмечено, что каждый из очерченных в статье субъектов владеет своим, особым административно-правовым статусом, который позволяет им организовать различные аспекты деятельности учреждений высшего образования со специфическими условиями обучения.
