Конституційні цінності як основа суспільного договору

Abstract

Відзначено, що договірний характер конституції навіть після її офіційного прийняття не вичерпується: після прийняття починається її «реальне» життя і, відповідно, життя суспільства за нею та водночас, всі ті природничі цінності конституції направлені на їх використання за призначенням, а саме суспільством, яке на це має беззастережне право, повинні бути використана на благо як індивідуума, так і соціуму в цілому. Тому конституція є тим договірним інструментом суспільства, який дозволяє кожній людини використовувати її постулати як основу свого буття, основу свого життя та основу здорового демократичного суспільства.It is noted that the contractual nature of the constitution, even after its official adoption, does not end: after adoption, its "real" life begins and, accordingly, the life of society according to it, and at the same time, all those natural values ​​of the constitution are directed to their intended use, namely, by society, which has an unconditional right to do so, and must be used for the benefit of both the individual and society as a whole. Therefore, the constitution is that contractual instrument of society that allows each person to use its postulates as the basis of his existence, the basis of his life and the basis of a healthy democratic society.
