Правові засади підтримки та розвитку бізнесу в умовах воєнного стану

Abstract

У статті виділено коло ключових нормативно-правових актів різної юридичної сили, які в своїй сукупності складають систему правових засад підтримки та розвитку бізнесу в умовах воєнного стану. Надано змістовну характеристику нормативно-правовим актам, норми яких спрямовані на регулювання суспільних відносин у досліджуваній сфері суспільного життя.

It is argued that the normative legal acts that regulate business activities during martial law, in particular regarding its stimulation and development, are most expediently divided into the following groups: 1) normative documents that establish certain restrictions and additional obligations on the subjects of implementation business; 2) acts that are aimed at stimulating and supporting the development of business without regard to the special situation in force in the country; 3) legal acts containing additional measures for the stimulation and development of business, which are valid only during martial law. It is noted that the legal basis for business support and development in the conditions of martial law is the foundation that allows it to continue its stable work under diffi cult conditions for the country. They are determined by legal acts of different legal force. Thus, according to the Constitution of Ukraine, certain rights, in particular: the right to freedom of entrepreneurial activity, the inviolability of property rights, may be limited. At the same time, the Constitution establishes guarantees for the protection of citizens against the arbitrariness of state authorities by establishing the duties of the latter, including for entrepreneurs, whose actions cannot be limited in connection with the maintenance of martial law. In turn, the laws and by-laws aimed at stimulating business development in Ukraine not only did not lose their validity, but were also strengthened by additional measures. The considered legal principles include the main principles of the relationship between the state as a subject of ensuring business activities in wartime and entrepreneurs as those who carry out their activities within the limits established by legal requirements.

В статье выделен круг ключевых нормативно-правовых актов разной юридической силы, которые в своей совокупности составляют систему правовых основ поддержки и развития бизнеса в условиях военного положения. Дана содержательная характеристика нормативно-правовым актам, нормы которых направлены на регулирование общественных отношений в исследуемой сфере общественной жизни.
