dc.description.abstractВизначено роль науки екологічного права та розробок учених у цій галузі у розвитку екологічного законодавства та практики правотворення. Розглянуто проблемні приклади неналежного врахування розробок та позицій учених в історії прийняття законодавчих актів у сфері охорони природи та використання її компонентів. Запропоновано шляхи подолання негативних проявів ігнорування наукових позицій у законодавчій діяльності.ru_RU.UTF8
dc.description.abstractThe role of science of environmental law and developments of scholars in this field for the development of environmental legislation and the practice of law-making, which aims at direct impact of research on the development and adoption of regulations. It is offered to change the approach of scholars to legislation through consideration of legislation as an object of necessary improvements, but not axioms, which is not the subject of revision. Analysis of the practice of improper consideration of the developments and positions of scholars in the history of the adoption of legislative acts in the field of environmental protection and use of its components has been conducted. The ways to overcome the negative effects of ignoring scientific positions within legislative activities have been offered. Among them the author has distinguished the following: proper planning of legislative work by the legislator, which allows to distribute efforts of the authors of the drafts of legislative acts both in time and on the number of persons, finding and involvement of scholars who are the best in the mentioned field; establishing mandatory consideration of the positions of scholars in the practice of lawmaking; creating an effective mechanism to inform about the results of legal research to the legislator.en
dc.description.abstractОпределена роль науки экологического права и разработок учёных в этой области в развития экологического законодательства и практики правотворчества. Рассмотрены проблемные примеры ненадлежащего учёта разработок и позиций учёных в истории принятия законодательных актов в сфере охраны природы и использования её компонентов. Предложены пути преодоления негативных проявлений игнорирования научных позиций в законодательной деятельности.ru
