Abstract

Встановлено правовий режим майна виробничих кооперативів та роз'яснено його ключові аспекти у контексті сучасного правового середовища. Показано, що існують розбіжності та невизначеності у правовому статусі майна виробничих кооперативів, що потребує уточнення та узгодження законодавства. Визначено, що майно кооперативу належить йому не тільки на праві власності, а й інших речових прав, таких як оренда та позичка. Можливе виникнення інших правових режимів на майно кооперативу, таких як інтелектуальна власність або корпоративні права. Правовий режим майнових прав передбачає вимогу щодо коштів, отриманих від господарської діяльності, створених підприємств кооперативу, благодійних внесків та інших надходжень.

In contemporary legal discourse, significant attention is devoted to production cooperatives as one of the primary forms of economic activity. However, questions regarding the legal regime of property of these associations remain subjects of debate and uncertainty. Specifically, there are different perspectives on issues of ownership and use of property by production cooperatives, creating the need for detailed legal analysis to determine the legal status and regime of this property. Thus, the main objective purpose by this article is to establish the legal regime of property for production cooperatives and clarify its key aspects within the context of the modern legal environment. The methods employed include legislative analysis regulating relations in the field of production cooperatives to determine the legal regime of property for these associations, as well as legal modeling to create a legal framework of the property regime for production cooperatives based on theoretical and practical data. Results. Various perspectives on issues of ownership and the legal regime of property for production cooperatives have been elucidated, and the legal status of this property within the context of the modern legal environment has been determined. The impact of the property regime on relations between production cooperatives and their members, including issues of ownership, use, and disposal of property, has been investigated. It has been established that not all property of a production cooperative belongs to it under the right of ownership. Ownership of such property may be based on other proprietary rights or rights arising from intellectual property, corporate, and contractual legal relations. Conclusions. It has been demonstrated that there are discrepancies and uncertainties in the legal status of property owned by production cooperatives, which requires clarification and harmonization of legislation. It has been determined that the property of a cooperative belongs to it not only on the basis of ownership rights but also other property rights such as lease and borrowing. The emergence of other legal regimes for cooperative property is possible, such as intellectual property or corporate rights. The legal regime of property rights entails requirements regarding funds obtained from economic activities, created enterprises of the cooperative, charitable contributions, and other receipts.

Установлен правовой режим имущества производственных кооперативов и разъяснены его ключевые аспекты в контексте современной правовой среды. Показано, что существуют разногласия и неопределенности в правовом статусе имущества производственных кооперативов, что требует уточнения и согласования законодательства. Определено, что имущество кооператива принадлежит ему не только на праве собственности, но и других вещных правах, таких как аренда и ссуда. Возможное возникновение других правовых режимов на имущество кооператива, таких как интеллектуальная собственность или корпоративные права. Правовой режим имущественных прав предусматривает требование средств, полученных от хозяйственной деятельности, созданных предприятий кооператива, благотворительных взносов и других поступлений.
