Анотація
Наведено точки зору вчених щодо правової природи трудового договору. Відзначено, що
призначенням трудового договору є встановлення умов праці конкретного працівника. Обґрунтовано, що трудовий договір не є джерелом трудового права, оскільки не містить норм
права у власному значенні останньої дефініції. Досліджено історію впровадження та розвитку інституту трудового договору у національному законодавстві. Висловлено позицію,
щодо побудови переважної більшості відносин у сфері застосування громадянами здатності
до праці.
Scientists’ points of view on the legal nature of the labor contract are researched. It is noted that the purpose of the labor contract is establishment of working conditions of a particular employee. It is grounded that labor contract is not a source of labor law because it does not contain the law norms in the proper sense of the last definition. The history of implementation and development of the institution of labor contract within national legislation is researched. Attention is paid to the fact that labor contract should be considered today as the main reason of the employment relationship origin. Based on the social nature of this contract the author expresses the position that under current conditions the vast majority of relations in the sphere of using the ability to work by citizens must be made on this basis. It is noted that the current Labor Code of Ukraine does not clearly establish legal facts, which are the grounds for employment relationship origin. Instead, there is such a position in the draft of the Labor Code of Ukraine, which is being considered by Verkhovna Rada of Ukraine. Thus, in accordance with the Article 38 «Employment Relationship Origin» of the Draft the reason of employment relationship origin is a labor contract. Labor contract in the cases provided by law, statutory documents or regulations of the employer, collective agreement is concluded (changed) based on: 1) the appointment; 2) the election; 3) competition results; 4) court decision. The expediency to change above mentioned Article of the draft in an appropriate way is grounded. Because it is proved that the acts of appointment and acts of election are important as independent reasons of the employment relationship origin.
Приведены точки зрения ученых относительно правовой природы трудового договора. Отмечено, что трудовой договор предназначен для установления условий труда конкретного работника. Обосновано, что трудовой договор не является источником трудового права, поскольку не содержит норм права в собственном значении последней дефиниции. Исследована история внедрения и развития института трудового договора в национальном законодательстве. Высказана позиция относительно построения большинства отношений в сфере применения гражданами способности к труду.
