dc.description.abstractПісля Другої світової війни міжнародне співтовариство почало приділяти дедалі більше уваги захисту прав і свобод людини, про що свідчить прийняття низки основоположних міжнародних документів. Сьогодні захист прав і свобод людини стає пріоритетом не лише окремої демократичної держави, а й усього світу. Ряд Декларацій і Конвенцій декларують єдність міжнародного співтовариства у розвитку правової системи забезпечення прав і свобод людини. На сьогоднішній день демократичні держави ратифікували більшість із цих документів, тим самим зобов’язавшись привести національне законодавство у відповідність до європейських правових стандартів у сфері прав і свобод людини. Водночас з кожного правила є певні винятки, як і у сфері прав і свобод людини, оскільки правова рівність не може бути однаковою для кожної людини, звичайно, за винятком таких основних прав, як права на життя і здоров'я, оскільки про їх обмеження не може бути й мови. У зв’язку з цим у статті робиться спроба відповісти на запитання, суть якого полягає в тому, що забезпечення прав і свобод людини не означає рівності для всіх.
dc.description.abstractAfter the Second World War, the international community began to pay more and more attention to the protection of human rights and freedoms, as evidenced by the adoption of a number of fundamental international documents. Nowadays, the defense of human rights and freedoms is becoming a priority not only for a single democratic state, but also for the entire world. A number of Declarations and Conventions declare the unity of the international community in the development of the legal system for ensuring human rights and freedoms. To date, democratic states have ratified most of these documents, thereby committing themselves to bring their national legislation in line with European legal standards in the field of human rights and freedoms. At the same time, there are certain exceptions to every rule, which is also the case in the area of human rights and freedoms, since legal equality cannot be the same for every person, of course, with the exception of such fundamental rights as the right to life and health, since their restriction is out of the question. In this regard, the article attempts to answer the question, the essence of which is that ensuring human rights and freedoms does not mean equality for everyone.
dc.description.abstractПосле Второй мировой войны международное сообщество стало уделять все больше внимания защите прав и свобод человека, о чем свидетельствует принятие ряда основополагающих международных документов. В наши дни защита прав и свобод человека становится приоритетом не только отдельного демократического государства, но и всего мира. Ряд деклараций и конвенций декларируют единство международного сообщества в развитии правовой системы обеспечения прав и свобод человека. На сегодняшний день демократические государства ратифицировали большую часть этих документов, взяв на себя тем самым обязательства привести свое национальное законодательство в соответствие с европейскими правовыми стандартами в области прав и свобод человека. В то же время из каждого правила существуют определенные исключения, как и в области прав и свобод человека, поскольку юридическое равенство не может быть одинаковым для всех людей, конечно, за исключением таких фундаментальных прав, как право на жизнь и здоровье, поскольку об их ограничении не может быть и речи. В связи с этим в статье предпринята попытка ответить на вопрос, суть которого состоит в том, что обеспечение прав и свобод человека не означает равенства для всех.
dc.description.abstractApós a Segunda Guerra Mundial, a comunidade internacional começou a prestar cada vez mais atenção à protecção dos direitos humanos e das liberdades, como evidenciado pela adopção de uma série de documentos internacionais fundamentais. Hoje em dia, a defesa dos direitos humanos e das liberdades torna-se uma prioridade não só para um único Estado democrático, mas também para todo o mundo. Várias Declarações e Convenções declaram a unidade da comunidade internacional no desenvolvimento do sistema jurídico para garantir os direitos humanos e as liberdades. Até à data, os Estados democráticos ratificaram a maior parte destes documentos, comprometendo-se assim a alinhar a sua legislação nacional com as normas jurídicas europeias no domínio dos direitos humanos e das liberdades. Ao mesmo tempo, existem certas excepções a todas as regras, o que também acontece no domínio dos direitos humanos e das liberdades, uma vez que a igualdade jurídica não pode ser a mesma para todas as pessoas, claro, com excepção de direitos fundamentais como o direito à vida e à saúde, uma vez que a sua restrição está fora de questão. A este respeito, o artigo tenta responder à questão cuja essência é que garantir os direitos humanos e as liberdades não significa igualdade para todos.
