dc.description.abstractДоведено, що охорона прав інтелектуальної власності у сфері освіти та захист прав інтелектуальної власності розглядаються як нерозривні поняття, кожне з яких, володіючи певною мірою незалежності, спрямовується на різнорівневе забезпечення прав суб’єктів інтелектуальної власності у сфері освіти. Встановлено, що термін «охорона» є більш широким стосовно терміна «захист», і саме з нього починається процес гарантування того або іншого права або законного інтересу.
dc.description.abstractThe author of the article stresses that Ukraine’s current regulatory base provides legal protection of intellectual property’s objects and the procedure of their usage. However, the practice of law implementation has identified a number of problems associated with the incompatibility of some of the norms to international law, guaranteeing effective protection of intellectual property’s objects and the creation of a civilized market of these objects. Therefore, legislation improvement and development of effective mechanisms to protect the rights in the sphere of intellectual property is an important factor in ensuring the growth of scientific and technical potential of Ukraine, realization of international exchange, trade and business expansion. The content of the concept of intellectual property rights’ security in the sphere of education and intellectual property rights’ protection in the sphere of education as inseparable concepts is revealed, where each of them having a certain degree of independence is aimed at guaranteeing the rights of intellectual property’s subjects in the sphere of education on different levels. It is proved that the term «security» is wider in respect to the term «protection» and the process of guaranteeing this or that right or legitimate interest begins from this term.
dc.description.abstractДоказано, что охрана прав интеллектуальной собственности в сфере образования и защита прав интеллектуальной собственности рассматриваются как неразрывные понятия, каждое из которых, обладая известной степенью независимости, направляется на разноуровневое обеспечение прав субъектов интеллектуальной собственности в сфере образования. Установлено, что термин «охрана» является более широким по отношению к термину «защита», и именно с него начинается процесс обеспечения того или иного права или законного интереса.
