dc.description.abstractРозроблено та представлено принципову схему "Модель кримінально-правового регулювання", яка виражена у формі текстового переліку. Здійснено перехід до принципової схеми "Модель кримінально-правового регулювання" через декілька ітерацій уточнень шляхом поступового введення ознак таких уявлень, як "діяльність", "управління", "правове регулювання", "кримінально-правове регулювання". Наводиться мовний опис "Моделі". "Модель кримінально-правового регулювання" відповідає ознаці "фальсифікованості" та придатна для емпіричної перевірки, а також може використовуватися у якості патерну при оцінці фактичних актів кримінально-правового регулювання, зокрема кримінально-правового нормування.
dc.description.abstractThe development of criminal legal thought in Ukraine does not stand still, and over time, well-known and used theories exhaust their cognitive potential and are subject to replacement. This is currently happening with the concept "Mechanism of criminal legal regulation", which is proposed to be replaced, in particular, with the concept "Model of criminal legal regulation". Since the "Model of Criminal Law Regulation" is a hypothesis-novel of the science of criminal law and the doctrine of the criminal law policy of combating crime in particular, it is natural that its development should begin precisely with the description of the principle scheme of criminal law regulation. Purpose of this publication is to describe the "Model of Criminal Law Regulation" at the level of "principle scheme". Methods of performing the task were the modeling method, which should ensure the adequacy of the "Model of criminal legal regulation" with the modern provisions of the criminal legal doctrine of Ukraine on criminal legal regulation and the method of system analysis, which should provide an idea of it as a conceptual system and as an element of other systems , in particular, the real system of legal regulation in Ukraine, as a subsystem of the corresponding society. The results of the study include a description of the "Model of Criminal Law Regulation" as a principle scheme. Conclusions. The article transitions to the principle scheme of the "Model of Criminal Law Regulation" due to gradual complication by introducing the features of "management", "activity", "legal regulation", "criminal legal regulation". "Model of Criminal Law Regulation" corresponds to the sign of "falsifiability" and is suitable for empirical verification. The "Model of Criminal Law Regulation" is suitable for use as a pattern for evaluating actual acts of criminal law regulation, in particular criminal law regulation.
dc.description.abstractРазработана и представлена ​​принципиальная схема "Модель уголовно-правового регулирования", которая выражена в форме текстового перечня. Совершен переход к принципиальной схеме "Модель уголовно-правового регулирования" через несколько итераций уточнений путем постепенного введения признаков таких представлений, как "деятельность", "управление", "правовое регулирование", "уголовно-правовое регулирование". Приводится языковое описание "Модели". "Модель уголовно-правового регулирования" соответствует признаку "фальсификации" и пригодна для эмпирической проверки, а также может использоваться в качестве паттерна при оценке фактических актов уголовно-правового регулирования, в частности уголовно-правового нормирования.
