Анотація
Наголошено, що «політичний вимір» конституції отримує своє відображення у тому, що вона обов’язково закріплює такі елементи політичної системи:
політичні засади конституційного ладу, конституційно-правовий статус громадянин та їхніх спільнот у політичній системі, а також конституційну форму держави,
місцевого самоврядування та громадянського суспільства. Зазначено, що ті чи інші
групи конституційних норм є першоосновою для формування відповідних генеральних інститутів конституційного права та структурування самого основного
закону. Продемонстровано, що перелічені елементи політичної системи можуть
виокремлюватись в окремі розділи чи глави конституції, а можуть бути представлені певною мірою в різних її структурних елементах, у тому числі як в основній
частині, так і в преамбулі. Саме другий, консолідуючий підхід застосовується у
переважній більшості конституцій четвертого покоління.
The Constitution has a mixed political and legal nature, as well as, to a large extent, all constitutional law, taking into account the specifics of its subject matter. Constitutional and legal relations that develop on the basis of its norms can also be qualified as having a dual nature: political and legal at the same time. However, in existing studies there is no comprehensive comparative legal analysis of the constitutions of modern states taking into account the specific historical conditions for their adoption, which would clearly demonstrate specific approaches to the constitutional consolidation of the political system of society and highlighted specific types of legal relations that define the “political dimension” of the modern constitution itself. The purpose of this article is to determine how the “political dimension” is displayed in the structure and content of the constitution, which particular provisions of the Basic Law form such a “dimension” at the present stage of development of world constitutionalism. As a result of a comparative legal study of the texts of modern constitutions, the conclusion is substantiated that the “political dimension” of the constitution is reflected in the fact that it necessarily fixes such elements of the political system: the political foundations of the constitutional system, the constitutional legal status of citizens and their communities in the political system, as well as the constitutional form of the state, local government and civil society. It is noted that certain groups of constitutional norms are the primary basis for the formation of the corresponding general institutions of constitutional law and the structuring of the Basic Law itself. It is demonstrated that the listed elements of the political system can be divided into separate sections or chapters of the constitution, and can be represented to a certain extent in its various structural elements, including both in the main part and in the preamble. The second, consolidating approach is applied in the vast majority of fourth-generation constitutions.
