dc.description.abstractНа основі аналізу наукових точок зору вчених, визначено сутність юридичної відповідальності в трудовому праві. Виокремлено ключові властивості цього терміну. Наголошено, що правовим змістом юридичної відповідальності у трудовому праві є негативний обов’язок, тобто такий, що покладається на учасника трудових відносин проти його волі в наслідок вчинення ним порушення норм трудового права, і полягає у необхідності зазнати правопорушником для себе певних негативних наслідків у вигляді позбавлень, обтяжень чи обмежень.uk_UA.UTF8
dc.description.abstractIn the article the essence of legal liability in labor law is determined, on the basis of analysis of scientific points of view of scientists. The key properties of this term are singled out. It is stressed that the legal content of legal liability in labor law is a negative obligation. Its mean, that a participant in labor relations in consequence of his committing a violation of labor law, against his will need to experience for himself certain negative consequences in the form deprivations, encumbrances or restrictions. It is shown that the main features of responsibility in labor law should include the following: – the grounds for the prosecution of labor liability are violations by the party (parties) to an employment contract of their duties provided for in this contract and labor legislation; – does not arise between the offender and the state, but between the offender and the subject with whom he is in labor relations. In the case, however, if the dangerous consequences of unlawful actions cause damage not only to the other side of labor relations, but also to the public interest, then there is no longer labor law, in that case comes another responsibility – administrative or criminal, depending on which norms of the branch of law are violated interests are guarded, and what is the level of danger of these harmful effects. That is, the implementation of labor and legal responsibility does not imply the emergence of new legal relationships between the offender and the state, represented by its competent authority. It has internal character - that’s mean arises and is exercised between the same subjects and within the same labor relations as the main obligations;– has mediated nature of the relationship of labor and legal responsibility with the state. Although the state, represented by its competent entities, is not directly involved in the legal liability relationship in labor law, it also contributes to its functioning, through the determination of the material and legal procedural and procedural principles of the emergence and implementation of labor and legal liability ; – regulates both in a centralized manner and in local regulatory documents.en

Отмечено, что правовым содержанием юридической ответственности в трудовом праве является отрицательная обязанность, которая возлагается на участника трудовых отношений против его воли в результате совершения им нарушения норм трудового права, и заключается в необходимости испытать правонарушителем определенные негативные последствия в виде лишений, обременений или ограничений.ru
