Дослідження правових систем світу у сучасних історичних умовах вимагає удосконалення їх
класифікації. Це пов’язано з впливом глобалізації на право, внаслідок чого на правовій карті світу з’являються правові системи, які складно віднести до якогось з існуючих типів. Крім того, всередині окремих типів правових систем
відбувається внутрішня диференціація, яка має бути відображена у науковій типології. Це, зокрема, стосується розвитку змішаних правових систем.
The study of the legal systems of the world in modern historical conditions requires the improvement of
their classification. He is due, among other things, to the impact of globalization on the law, because of which on the legal
map of the world appear legal systems, which are difficult to attribute to any of the existing types. In addition, within certain
types of legal systems, there is an internal differentiation, which should be reflected in the scientific typology. This applies in
particular to the development of mixed legal systems. The purpose of the study is to substantiate the thesis of the existence
of two types of mixed legal systems and to reveal their features. For this purpose, the following methods were used:
hermeneutic – to clarify the essence of scientific approaches to understanding the mixed legal system; comparative – to
reveal the differences between existing models of mixed legal systems; formal-logical – to formulate their criteria for the
classification of mixed legal systems and to distinguish their types. Results. It has been established that during the last
hundred years the attitude of scholars to the mixed type of legal systems has significantly changed. If earlier most authors
perceived this type as atypical and exotic, today its existence is practically beyond doubt. Moreover, some authors even
argue that in modern conditions, all legal systems are mixed in nature. There are also many attempts to classify mixed legal
systems, but they lack clarity of criteria. It is proposed to distinguish between hybrids and pluralistic among mixed legal systems, the differences between them are outlined. Conclusions. The current state of comparative legal research allows
us to point out significant differences between hybrid and pluralistic varieties of mixed legal systems. The first type is formed
due to the intertwining of norms and institutions of different types of legal systems (primarily – Romano-Germanic and
Anglo-American) in a certain territory; the second type provides for the parallel coexistence in the state of different
regulations addressed to different groups of the population.
