Напрями вдосконалення адміністративного законодавства, яке регулює порядок забезпечення та реалізації права особи адвокатом на безоплатну вторинну правову допомогу в адміністративному судочинстві в Україні

Abstract

Виокремлено певні напрямки, які повинні сприяти покращенню прав особи адвокатом на безоплатну вторинну правову допомогу в адміністративному судочинстві в Україні, а також запропоновано відповідні зміни до норм чинного законодавства, спрямованого на вдосконалення надання безоплатної вторинної допомоги в адміністративному судочинстві.

The scientific article singles out certain directions that should contribute to the improvement of the rights of a person by a lawyer to free secondary legal assistance in administrative proceedings in Ukraine: 1) gradually expand the circle of persons who have the right to receive free legal assistance and increase the list of cases in which it is provided; 2) maximally simplify the procedure of access to free legal aid; 3) to increase the intensity of informing relevant sections of the population about the possibility of obtaining free secondary legal assistance; 4) introduction of a mechanism for assessing the quality of legal assistance provided by a lawyer using a peer review tool, which will contribute to the quality provision of free secondary assistance; 5) amending the Law of Ukraine «On Free Legal Aid» in order to define and consolidate the rights and obligations of the subject of the right to free secondary legal aid; 6) it becomes necessary to introduce the norms of the current legislation regarding the terminological application of the category «legal aid» in accordance with the Constitution of Ukraine; 7) there are contradictions that arise in the system of free secondary legal aid due to the impossibility of fully ensuring the realization of the constitutional right of a person to freely choose a defender of his rights. To ensure this right, it is necessary to ensure a high level of awareness of individuals about each individual lawyer, as well as a high speed of communication between a person in need of legal assistance and centers providing secondary legal assistance.

Выделены определенные направления, которые должны способствовать улучшению прав человека адвокатом на бесплатную вторичную правовую помощь в административном судопроизводстве в Украине, а также предложены соответствующие изменения в нормы действующего законодательства, направленного на усовершенствование предоставления бесплатной вторичной помощи в административном судопроизводстве.
