Закупівля послуг з юридичного консультування та юридичного представництва

Abstract

Здійснено критичний аналіз договору про закупівлю послуг з юридичного консультування та юридичного представництва за допомогою цивільно-правового інструментарію. Розроблено критерії виявлення в нормах про публічні закупівлі алогізмів, які прямо протирічать нормам цивільного законодавства про договір консалтингу. Узагальнено основні концептуальні протиріччя між договором про закупівлю послуг з юридичного консультування і юридичного представництва та цивільно-правовим договором консалтингу.

The article is devoted to the consideration of topical issues in public procurement that have arisen in the course of the current recodification of the Civil Code of Ukraine, military aggression against Ukraine and the corresponding changes in economic relations under martial law. The legislator has responded to these changes by adopting a number of new regulations that have fundamentally changed the rules for public procurement. However, entities and participants in public procurement deserve proper legal protection of their rights and interests in conducting public procurement, even in such a challenging situation for Ukraine. Because the majority of public procurement relations are not only complex in their legal nature, but also require the actual participation of representatives in procedural relations, and therefore there is a constant demand for legal consulting and legal representation services. The authors have examined the general dynamics of changes in the regulatory framework for public procurement during martial law. They have summarised research papers on public procurement of legal consulting and legal representation services. The most expensive public procurement procedures for purchasing legal consulting and legal representation services have been additionally analysed from the «Prozorro» system. The exemptions for procurement of legal services used by the National Bank of Ukraine to represent its interests in foreign authorities, as well as legal services related to the protection of its rights and interests in dispute resolution and proceedings in foreign jurisdictions have been analysed through the prism of anti-corruption legislation in the article. The authors of the article have adopted the general legal definition of legal consulting and representation. They also have made their own analysis of the concept of a public procurement contract. The main conceptual contradictions between the contract for the procurement of legal consulting and legal representation services and the civil law consulting contract have been identified and characterised.

Проведен критический анализ договора о закупке услуг по юридическому консультированию и юридическому представительству с помощью гражданско-правового инструментария. Разработаны критерии выявления в нормах о публичных закупках алогизмов, прямо противоречащих нормам гражданского законодательства о договоре консалтинга. Обобщены основные концептуальные противоречия между договором о закупке услуг по юридическому консультированию и юридического консульства и гражданско-правовым контрактом консалтинга.
