Щодо захисту прав жінок військовослужбовиць в умовах російсько-української війни

Abstract

Досліджено основні законодавчі норми, які забезпечують захист прав жінок-військовослужбовиць. Визначено основні аспекти, які пов’язані з цим питання, такі як доступ до медичної допомоги, запобігання сексуальному насильству, рівні можливості для професійного розвитку, забезпечення формою та іншими потребами. Охарактеризовано групи гендерної нерівності та шляхи вирішення цього питання в Україні в умовах російсько-української війни. Зроблено висновок, що, незважаючи на те, що кількість жінок-військовослужбовиць збільшилася протягом останніх років, їхня участь в російсько-українській війні та поступові зміни в законодавчій базі, спрямовані на рівність прав чоловіків і жінок у військовій сфері, не вирішують багатьох складних проблем, які вимагають подальшого вирішення.

In today’s world, women are actively becoming a force that moves society forward. In Ukraine, particularly in the defense sector, strong patriarchal traditions dominate. However, female military servicemen from Ukraine are increasingly being recognized by Ukrainian society and the country’s political leadership, especially in wartime conditions. Today, women show confidence in their abilities and are ready to take responsibility and perform difficult tasks. Since February 20, 2014, when Crimea was annexed, many Ukrainian women took up arms and stood up to defend our Motherland. In nine years, the number of female soldiers in the Armed Forces of Ukraine has increased by 2.5 times. The problem of protecting women’s rights in the context of military conflicts is complex and requires international legislation. The article examined the main legislative norms that ensure the protection of the rights of female military personnel. The main aspects related to this issue are identified, such as access to medical care, prevention of sexual violence, equal opportunities for professional development, provision of uniforms and other needs. Groups of gender inequality and ways of solving this issue in Ukraine in the conditions of the Russian-Ukrainian war are characterized. It was concluded that despite the fact that the number of female military personnel has increased in recent years, their participation in the Russian-Ukrainian war and gradual changes in the legislative framework aimed at equal rights of men and women in the military sphere do not solve many complex problems that require further resolution. Among them, first of all, it is worth noting the still existing negative stereotypes regarding the role and place of women in the army. It is also important to solve domestic issues related to the infrastructure that does not take into account the needs of women, because now it is mainly focused on the needs of men. Steps must also be taken to ensure equal opportunities for women in leadership positions.

Исследованы основные законодательные нормы, обеспечивающие защиту прав женщин-военнослужащих. Определены основные аспекты, связанные с этим вопросом, такие как доступ к медицинской помощи, предотвращение сексуального насилия, уровни возможности для профессионального развития, обеспечения формой и другими потребностями. Охарактеризованы группы гендерного неравенства и пути решения этого вопроса в Украине в условиях русско-украинской войны. Сделан вывод, что, несмотря на то, что количество женщин-военнослужащих увеличилось за последние годы, их участие в российско-украинской войне и постепенные изменения в законодательной базе, направленные на равенство прав мужчин и женщин в военной сфере, не решают многих сложных проблем, требующих дальнейшего решения.
