Історія криміналізації примусового переміщення дітей з однієї людської групи до іншої як форми геноциду

Abstract

Надано аналіз міжнародного досвіду криміналізації примусовогопере міщення дітей з однієї людської групи до іншої як форми геноциду. У контексті криміналізації злочину геноциду досліджено найбільш юридично значимі в новітній історії людства приклади примусового переміщення дітей до іншої людської групи. Визначено можливість застосування історичних прикладів і матеріалів відповідних кримінальних справ у доведенні обвинувачення в примусовому переміщенні українських дітей з окупованих територій України до Російської Федерації.

The International Criminal Court pressed charges against Russian Federation authorities for the war crime of unlawful transfer of children from occupied areas of Ukraine to the Russian Federation, which generated scientific and political discussion about possibility to recognize actions of the Russian leaders as a crime of genocide. The objective of the article is to research criminalization of forcibly transferring children from one human group to another as a form of genocide. In the context of criminalization of genocide, the article researches the most notable examples of forcibly transferring children in modern history, namely, transferring Armenian children during massacres of Armenians by the Ottoman Empire in 1915-1916, forcibly transferring alien children by Nazi Germany officials in 1939-1944 and mass transferring of Greek children during the Greek Civil War 1946-1949. The article defines that international condemnation of massacres of Armenians in 1915-1916 allowed to substantiate the concept of crimes against humanity, but forcibly transferring Armenian children aimed at erasing their national identity did not receive international attention. The article identifies contribution of R. Lemkin in criminalizing forcibly transferring children. Analyzing Poland vs. Greiser and RuSHA cases the article identified that in both cases genocide is defined as one of the crimes against humanity, but its content differs from contemporary definition of genocide under the Convention on the Prevention and Punishment of the Crime of Genocide, 1948. The article studies impact of transferring Greek children during the Greek Civil War 1946-1949 on criminalization of forcibly transferring children. It identifies the role of R. Lemkin, delegates of Greece and other countries in preparing the final draft of the convention on genocide. The article ascertains absence of practical application of the Article ІІ(е) the Convention on the Prevention and Punishment of the Crime of Genocide, 1948. It concludes that highlighted historical examples and criminal cases can be utilized in prosecuting forcibly transferring Ukrainian children from occupied areas of Ukraine to the Russian Federation, nevertheless bearing in mind historical context and legal aspects of the latter.

Представлен анализ международного опыта криминализации принудительного перемещения детей из одной человеческой группы в другую как форму геноцида. В контексте криминализации преступления геноцида исследованы наиболее юридически значимые в новейшей истории человечества примеры принудительного перемещения детей в другую человеческую группу. Определена возможность применения исторических примеров и материалов соответствующих уголовных дел в доказывании обвинения в принудительном перемещении украинских детей с оккупированных территорий Украины в Российскую Федерацию.
