Морально-етичні, організаційні та правові засади оцінювання роботи судів в Україні та світі

Abstract

Окреслено морально-етичні, організаційні та правові засади оцінювання роботи судів в Україні та світі. Розкрито сутність морально-етичних засад оцінювання роботи судів на основі встановлення тісного взаємозв’язку правосуддя з релігією та мораллю, що бере свій початок із стародавніх часів. Проаналізовано практику оцінювання роботи судів (спеціалізованих судів) у Франції, Польщі, Австралії та США. Визначено правові та організаційні засади оцінювання роботи судів в Україні.In order to understand the worldview and moral and ethical principles of evaluating the work of courts, which are primary and systemforming in relation to organizational and legal ones, the historical path of the formation of the categories «court» and «judge», including at the level of the first civilizations in history, is clarified in the article humanity and religions, which gave these categories a sacred, «divine» meaning. In the context of moral and ethical principles, the close relationship of justice with religion and morality, which originates from ancient times, is emphasized. Accordingly, the core, worldview aspects of court activity and the formation of a judge’s personality can be traced precisely at the level of analysis of data from historical periods, religious teachings and personalities who acted as «original judges». It is noted that over time, the progressive vision of the judge’s profession was accompanied by a change in approaches to the assessment process as such, which is based not on the will of the ruler, not on «God’s providence», but on the laws of logic and thinking, based on specific arguments. It is emphasized that an important component of evaluating the work of the court is the search for a suitable ideal, a model not only at the level of universal moral and ethical principles, but also in the practice of the functioning of courts, including in other countries, comparing and generalizing such practice with its simultaneous extrapolation to domestic socio-economic and political-legal realities. The generalization of such foreign experience allows to determine the understanding of the optimal legal and organizational principles for evaluating the work of courts. In particular, we analyzed approaches to evaluating the work of courts in France, Poland, Australia and the USA. Including the role of foreign experience of public and scientific evaluation of the work of the court, which is more proactive, covers a wide range of methods and approaches. It is noted that in Ukraine, evaluation of the work of courts takes place at the level of the Council of Judges of Ukraine and the State Judicial Administration of Ukraine. The system of evaluation of the work of the court in Ukraine was approved by the decision of the Council of Judges of Ukraine dated April 2, 2015 No. 28, which defined the relevant standards, criteria, indicators and methods of evaluation of the work of the court.Обозначены морально-нравственные, организационные и правовые основы оценки работы судов в Украине и мире. Раскрыта сущность морально-нравственных основ оценивания работы судов на основе установления тесной взаимосвязи правосудия с религией и моралью, которая берет свое начало с древних времен. Проанализирована практика оценки работы судов (специализированных судов) во Франции, Польше, Австралии и США. Определены правовые и организационные основы оценки работы судов в Украине.
