Тактичні особливості проведення огляду місця події при розслідуванні посягань на життя працівника правоохоронного органу

Abstract

На підставі аналізу наукової літератури та практики органів досудового слідства розглянуто тактичні особливості проведення огляду місця події при розслідуванні посягань на життя працівника правоохоронного органу. Також проаналізовано зміст, завдання та значення огляду місця події, сформовано деякі тактичні прийоми з підготовки та проведення огляду місця події, визначено правила фіксації та вилучення об'єктів огляду. З огляду на вивчений матеріал, надано рекомендації, спрямовані на вдосконалення роботи з дослідження місця події із зазначеної категорії кримінальних проваджень.

Based on the analysis of the scientific literature and the practice of the pre-trial investigation bodies, tactical features of the inspection of the scene of an incident in the investigation of encroachments on the life of a law enforcement officer were considered. Also, the content, tasks and significance of the site inspection were analyzed, some tactical methods were developed to prepare and conduct an inspection of the scene, rules for fixing and seizing the objects of inspection were defined. Based on the material studied, recommendations were developed aimed at improving the work on the investigation of the scene of the incident in this category of criminal proceedings. The level of disclosure of a crime depends to a large extent on the initial investigative actions conducted, among which the review of the place of occurrence, which is the main source of evidence at the initial stage of the crime investigation, is of paramount importance. Investigation of the situation of the place of the event in investigating the encroachments on the life of the law enforcement officer (Article 348 of the Criminal Code of Ukraine) requires the various efforts of the investigator, the use of various technical means and tactical methods of detecting, fixing and extracting traces and material evidence.So, in investigating crimes related to attacks on the lives of law enforcement officials, the most common investigative action at the initial stage of the investigation is an overview of the place of the event. This is due to the fact that by means of a survey, traces of a criminal offense can be detected. In addition, this procedure allows the investigator to fully understand the location of the event, to understand the essence of the crime under investigation more deeply. Thus, performing tasks of reviewing the place of the event in investigating encroachments on the life of an employee of a law enforcement agency helps to obtain the initial data for the disclosure of a crime, the search and disclosure of the offender. The value of the tactics of the survey, the knowledge and skills of the persons involved in its conduct, compliance with the order of fixing and extracting objects of the crime is a guarantee of the success of this investigative action. All this leads to the need for a comprehensive and deeper investigation of the problem of reviewing the place of the event when investigating encroachments on the life of a law enforcement officer, taking into account modern theoretical studies in this field of criminalistics.

На основании анализа научной литературы и практики органов досудебного следствия рассмотрены тактические особенности проведения осмотра места происшествия при расследовании посягательств на жизнь сотрудника правоохранительного органа. Также проанализированы содержание, задачи и значение осмотра места происшествия, сформированы некоторые тактические приемы по подготовке и проведению осмотра места происшествия, определены правила фиксации и изъятия объектов осмотра. На основании изученного материала выработаны рекомендации, направленные на совершенствование работы по исследованию места происшествия по указанной категории уголовных производств.
