Керівник прокуратури в умовах воєнного стану: забезпечення законності доказування

Abstract

Розглянуто певні проблемні аспекти, які пов’язані з участю керівника органу прокуратури в процесі доказування. Наголошено на пошук оптимальних моделей участі керівника органу прокуратури в доказуванні, а також на розробку ефективних механізмів контролю за його діяльністю, тому необхідно постійно вдосконалювати правове регулювання та практику застосування відповідних норм, щоб забезпечити належний баланс між повноваженнями керівника та принципами незалежності й неупередженості.Certain problematic aspects related to the participation of the head of the prosecution body in the process of providing evidence are considered. Emphasis is placed on the search for optimal models of participation of the head of the prosecution body in providing evidence, as well as on the development of effective mechanisms for monitoring his activities, therefore, it is necessary to constantly improve legal regulation and the practice of applying relevant norms in order to ensure the proper balance between the powers of the head and the principles of independence and impartiality.
