Деякі актуальні проблеми реформування інституту адміністративної відповідальності

Abstract

Проаналізовано деякі сучасні проблеми законодавчого регулювання адміністративної відповідальності в Україні. Наголошено на необхідності забезпечення реалізації конституційних принципів відповідальності, зокрема її індивідуалізації. Зроблено висновок про необхідність реального реформування законодавства про адміністративні правопорушення шляхом розробки і прийняття нового Кодексу України про адміністративні проступки.

Some modern problems of legislative regulation of administrative responsibility in Ukraine are analyzed in the article. It was mentioned that in 2012 due to the adoption of new Criminal Procedural Code of Ukraine the task to develop new Code of administrative offenses and Law on criminal offenses was made. Nevertheless neither first, nor second wasn’t adopted. Moreover, the draft of the Code of administrative offenses was made only in doctrinal level, the official draft is still absent. The new Code should consist only that offenses, which cases are considered in administrative order. Therefore, administrative offenses, which cases now consider by court (judges), it is expedient to define as criminal offenses. The necessity of ensuring the real codification of the legislation on administrative offenses is determined, wherefore to provide the mechanism, which would ensure concentration of all norms which set administrative responsibility, in Code of administrative offenses. It should also regulate the issue of administrative responsibility of legal entities, the recognition of which as the subjects of this responsibility in our time remains controversial. The necessity of ensuring of the constitutional principles of responsibility implementation, in particular its individualization, was highlighted. Attention is drawn to the spread of opinion about the decisive role of increasing of the amount of fines for offenses in the field of traffic safety in reducing the number of such offenses. The view on the increasing of severity of sanctions that had very little effect on reducing the number of offenses was maintained. The most effective legal remedy for this is to ensure the inevitability of legal responsibility. It is concluded that certain provisions of the Code of Ukraine on Administrative Offenses contradict not only the general principles of legal, in particular administrative responsibility, but also specific provisions of the Constitution of Ukraine, as well as other norms of the same Code. In connection with this, there is an urgent need for the adoption of a new Code of Administrative Offenses of Ukraine in which these contradictions and inconsistencies will be eliminated, and all norms will clearly meet the requirements of the Constitution of Ukraine and the principles of the state of law.

Проанализированы некоторые современные проблемы законодательного регулирования административной ответственности в Украине. Отмечена необходимость обеспечения реализации конституционных принципов ответственности, в частности ее индивидуализации. Сделан вывод о необходимости реального реформирования законодательства об административных правонарушениях путем разработки и принятия нового Кодекса Украины об административных проступках.
