Мародерство: у пошуках розуміння змісту діяння

Abstract

Статтю присвячено проблемі законодавчого визначення окремих складових такого злочину, як мародерство, відповідальність за яке встановлено у ст. 432 Кримінального кодексу України. Звернено увагу на наявну звуженість змісту мародерства в чинному кримінальному законі, показано й обґрунтовано доцільність включення до такого суспільно небезпечного діяння й інших видів поведінки, що з логічної точки зору послідовно відтворюють мародерство, як його наразі визначає Кримінальний кодекс України. Наголошено, що зміст чинної ст. 432 Кримінального кодексу України створює певні перепони у правильному розумінні визначеного нею діяння, особливо на тлі включення фактично притаманних йому атрибутів до змісту деяких інших кримінальних правопорушень. Висловлено думку про сумнівну припустимість такого підходу.

The article is devoted to the problem of doubtful legislative definition of such a relevant phenomenon as looting, liability for which is provided for in Article 432 of the Criminal Code of Ukraine. An attempt is made to identify the true meaning of the socially dangerous phenomenon under consideration on the basis of a brief etymological and semantic analysis, as well as with due regard for the comparative legal study of the relevant criminal law provisions of the legislation of some foreign countries. The relevance of the study has been highlighted, which is related to the lack of proper coverage of the content of looting. The approaches to understanding such an act in explanatory dictionaries and legal acts of European and Asian countries are outlined. Both supporting and rebuttal arguments have been provided. It has been noted that the national legislator's presentation of looting as an act which evidences the theft of things only on the battlefield and only from the military is not entirely consistent to what such an act actually means, given its origin and purpose. The current article of the Criminal Code of Ukraine only presents looting as a specific type of crime to a limited extent (in terms of content). At the same time, certain elements of unlawful behaviour that actually embody looting are for some reason included in other articles of the Special Part of the Criminal Code of Ukraine. This creates obstacles both in the correct definition of looting and in the correct assignment of other criminal offences with features that do not actually characterise them. It has been stated that the issue of proper definition of the looting content is very relevant today, since the undeclared war by Russia is ongoing in the country and the facts of property seizure, which are currently defined as components of various criminal offences, should be considered as looting. However, this should be clearly stated in the provision itself, which provides for liability for such an act. The article also differentiates between cases of actions that resemble looting in appearance, but are committed by civilians, as well as representatives of Russian units and persons supported by them from illegal armed groups fighting on the side of Russia.

Статья посвящена проблеме законодательного определения отдельных составляющих такого преступления, как мародерство, ответственность за которое установлено в ст. 432 Уголовного кодекса Украины. Обращено внимание на имеющуюся суженность содержания мародерства в действующем уголовном законе, показана и обоснована целесообразность включения в такое общественно опасное деяние и других видов поведения, связанных с логической точки зрения последовательно воспроизводят мародерство, как его определяет Уголовный кодекс. Отмечено, что содержание действующей ст. 432 Уголовного кодекса Украины создает определенные преграды в правильном понимании определенного ею деяния, особенно на фоне включения фактически присущих ему атрибутов к содержанию других уголовных правонарушений. Высказано мнение о сомнительной допустимости такого подхода.
