Злочини у сфері службової діяльності та професійної діяльності, повʼязаної з наданням публічних послуг як обʼєкт кримінологічного дослідження

Abstract

Визначено специфіку злочинів у сфері службової діяльності та професійної діяльності, повʼязаної з наданням публічних послуг, як обʼєкта кримінологічного дослідження. Підкреслено, що визначення обʼєкта злочинів у сфері службової діяльності та професійної діяльності, повʼязаної з наданням публічних послуг, а також виявлення його значення є важливим для правильного розуміння природи цієї групи злочинів, їх ознак для цілей кримінально-правової кваліфікації та дає можливість обґрунтувати проведену в Україні диференціацію режимів кримінально- правового впливу на корупцію.

The article identifies the specifics of crimes in the field of official activities and professional activities related to the provision of public services, as the object of criminological research. It is emphasized that the definition of the object of crimes in the field of official activities and professional activities related to the provision of public services, as well as its importance is important for understanding the nature of this group of crimes, their characteristics for criminal purposes and allows to substantiate the differentiation of the regimes of criminal-legal influence on corruption carried out in Ukraine. It is emphasized that currently the provisions of Chapter XVII of the Special Part of the Criminal Code are designed to protect four separate groups of public relations, which are distinguished by their content: 1) the content of which is established by law the procedure for exercising their powers 2) the content of which is the procedure established by law for the exercise of their powers by other officials (interests of private service); 3) the content of which is the procedure established by law for the exercise of their powers by persons who provide public services; 4) the content of which is the procedure established by law for the performance of their duties by persons in the field of sports. This division is based on the fundamental differences in the nature of the powers of public and private officials, their importance, as well as the characteristics of the powers of persons who provide public services and who work in the field of sports. At the same time, the structure of protected legal relations and the mechanism of violation of the object of crimes under Section XVII of the Special Part of the Criminal Code are the same, which is almost the only feature that led to the placement of these crimes in one section. In solving the problem of distinguishing between crimes against the order of management and the considered group of crimes by generic object should be borne in mind that if the duty to act in a certain way when committing an official crime rests with the employee, then when committing a crime against the subject affected by the activities of the state (municipal) body. In addition, crimes against the order of government, regardless of the subject of the relationship encroach on other elements (signs) of the state (municipal) body, and do not disrupt its work because of such a feature as performing the functions of this body, which can only directly commit an official or other special subject.

Определена специфика преступлений в сфере служебной деятельности и профессиональной деятельности, связанной с предоставлением публичных услуг как объекта криминологического исследования. Подчеркнуто, что определение объекта преступлений в сфере служебной деятельности и профессиональной деятельности, связанной с предоставлением публичных услуг, а также выявление его значения важно для правильного понимания природы этой группы преступлений, их признаков для целей уголовно-правовой квалификации и дает возможность обосновать проведенную в Украине дифференциацию режимов уголовно-правового влияния на коррупцию.
