Зарубіжний досвід протидії порушенням митних правил

Abstract

Висвітлено основні аспекти митного контролю та обміну досвідом міжнародної співпраці, представлено успішні приклади застосування інноваційних підходів і технологій для протидії порушенням митних правил. Встановлено, що : впровадження сучасних технологій та електронних систем сприяє покращенню ефективності митного контролю та зменшенню ризику порушень; митні аудити та перевірки є ефективним інструментом для підтвердження та забезпечення дотримання митних правил суб'єктами міжнародної торгівлі; важливою є ефективна міжнародна співпраця та обмін інформацією для успішної боротьби з порушеннями митних правил. Наголошено, що оновлення митного законодавства України відповідно до сучасних тенденцій правового регулювання, наявних у розвинутих демократичних країнах, може значно покращити митні процедури, забезпечити ефективність та прозорість митного контролю, сприяючи тим самим розвитку міжнародної торгівлі та зміцненню позицій України на світовому ринку.With the growth of international trade and the intensification of geopolitical challenges, the issue of effective control over the movement of goods across the customs border becomes particularly relevant. Violations of customs rules can have significant economic and security consequences for the country. In this context, the study of foreign experience in countering customs violations becomes an important task. The problem lies in identifying and analyzing effective measures already successfully implemented in other countries for their further adaptation to enhance the efficiency of customs control and ensure a high level of compliance with customs rules in Ukraine. The purpose of the article is to highlight the key aspects of customs control and the exchange of international cooperation experience, presenting successful examples of innovative approaches and technologies to counter customs violations. Methods used: systemic – for examining the customs control system in the context of all its components, including legal, organizational, and other aspects; logical and analytical – for using logic and analysis to reveal the causes and consequences of customs violations and developing proposals for further system improvement. Results. It has been established that the implementation of modern technologies and electronic systems contributes to the improvement of customs control efficiency and the reduction of violation risks. Customs audits and inspections prove to be effective tools for confirming and ensuring compliance with customs rules by international trade entities. Effective international cooperation and information exchange are crucial for successfully combating customs violations. Conclusions. The fight against customs violations and the establishment of effective sanctions and accountability are key elements. Such measures will promote compliance with customs norms and stimulate responsible behavior among business entities. Mutual recognition of standards, procedural unification, and the improvement of mechanisms for quality and safety control of goods can help Ukraine facilitate the circulation of goods and protect consumer interests. Specific directions for improving Ukraine's customs system include legislative enhancements, the development of electronic systems, and the increased efficiency of audits. It is noted that against the backdrop of changes in trade relations and geopolitical conditions, the updating of Ukraine's customs legislation in line with contemporary trends in legal regulation, as observed in developed democratic countries, can significantly enhance customs procedures, ensuring efficiency and transparency in customs control. This, in turn, contributes to the development of international trade and strengthens Ukraine's position in the global market.Освещены основные аспекты таможенного контроля и обмена опытом международного сотрудничества, представлены успешные примеры применения инновационных подходов и технологий для противодействия нарушениям таможенных правил.
