Нормативні засади вітчизняної кримінально-правової політики щодо запобігання насильницьких злочинів проти життя та здоров’я, що вчиняються із застосуванням вогнепальної зброї

Abstract

Визначено засади вітчизняної кримінально-правової політики щодо запобігання насильницьких злочинів проти життя та здоров’я, що вчиняються із застосуванням вогнепальної зброї відповідно до приписів нормативно-правових актів. Стверджено, що важливим аспектом кримінально-правової політики щодо запобігання озброєного кримінального насильства є врегулювання правил володіння цивільними особами мисливською вогнепальною зброєю. Підкреслено, що для самозахисту з використанням вогнепальної зброї принциповим є врегулювання правил необхідної оборони. Наголошено, що заходи на запобігання озброєного кримінального насильства мають реалізовуватись у контексті загальної кримінально-правової політики. Розкрито функції дозвільної системи як суб’єкта, який реалізує заходи кримінально-правової політики щодо запобігання злочинів проти життя та здоров’я з використанням вогнепальної зброї. Перспективним напрямком кримінально-правової політики щодо запобігання злочинів проти життя та здоров’я з використанням вогнепальної зброї стверджується впровадження інформаційних технологій. Йдеться, зокрема, про «Єдиний реєстр зброї» та застосування спеціальних інформаційноаналітичних систем.

In the conditions of a complex criminogenic situation caused by the full-scale aggression of the Russian Federation against Ukraine, the problem of criminal violence has acquired special importance, and the prevention of armed crimes against life and health has become an urgent challenge for the domestic law enforcement system. It is argued that the implementation of such measures should be carried out in the context of general criminal law policy and be based on appropriate theoretical foundations. The purpose of the article: improvement of the national crime prevention system. The task of the article: to determine the principles of domestic criminal law policy for the prevention of violent crimes against life and health, committed with the use of firearms in accordance with the prescriptions of normative legal acts. On the basis of the analysis of the current legislation, it is argued that there are two main aspects in which the domestic criminal law policy on the prevention of crimes against life and health with the use of firearms is manifested. First, it is about self-defense of citizens, the normative prerequisite of which is Article 27 of the Constitution of Ukraine. The specifics of the implementation of this right are regulated by laws and bylaws. It is argued that an important aspect of criminal law policy for the prevention of armed criminal violence is the regulation of the rules for the possession of hunting firearms by civilians. It is concluded that for self-defense with the use of firearms it is fundamental to regulate the rules of necessary defense in accordance with Article 36 of the Criminal Code of Ukraine. The second aspect in which the criminal law policy on the prevention of armed violence is implemented is the activity of state actors. It is emphasized that measures to prevent armed criminal violence should be implemented in the context of the general criminal law policy. The article reveals the functions of the permit system as an entity that implements measures of criminal law policy to prevent crimes against life and health with the use of firearms. The implementation of information technology is claimed as a promising direction of the criminal law policy regarding the prevention of crimes against life and health with the use of firearms. It is, in particular, about the "Unified Register of Weapons" and the use of special information and analytical systems.

Определены основы отечественной уголовно-правовой политики по предотвращению насильственных преступлений против жизни и здоровья, совершаемых с применением огнестрельного оружия в соответствии с предписаниями нормативно правовых актов.
