Анотація
У статті проаналізовано норми чинного законодавства, яке регулює особливості
здійснення підприємницької діяльності в умовах воєнного стану. Враховуючи те, що
забезпечення належного правового регулювання у сфері здійснення підприємницької діяльності в умовах воєнного стану є основою формування національних оборонних інтересів, проведено дослідження особливостей ведення підприємницької діяльності за таких умов. Визначено, що ведення підприємницької діяльності під час воєнного стану є складним процесом, спрямованим на забезпечення робочих місць для населення, сплату
податків до держави, що сприятиме допомозі армії та підтримці економіки в цілому.
Окрему увагу приділено питанню визначення особливостей реєстрації юридичних
осіб, фізичних осіб-підприємців під час дії воєнного стану. Аргументовано позицію, відповідно до якої з початком повномасштабного вторгнення у законодавстві було
прийнято низку змін, що пов’язані з оподаткуванням та поданням звітності у період
дії воєнного стану.
The article analyzes the norms of the current legislation, which regulates the peculiarities of entrepreneurial activity in the conditions of martial law. Taking into account the fact that the provision of proper legal regulation in the field of entrepreneurial activity under martial law is the basis for the formation of national defense interests, a study of the peculiarities of conducting entrepreneurial activity under such conditions was conducted. It was established that entrepreneurship, as a function of the economic and political environment, which determines its possibilities, types, motivations, forms the main directions of the state’s activity at a certain historical stage of its development, it reveals the mechanism of support for subjects of entrepreneurial activity. It was determined that the interaction and cooperation of the Ukrainian state and entrepreneurs will contribute, first, to the stability and development of the country’s economy; secondly, support of the economic potential of the state in extremely difficult conditions of martial law. Attention is focused on the fact that, in today’s conditions, in order to overcome negative consequences and phenomena, during the implementation of entrepreneurial activities, business entities should coordinate and systematically interact with each other and with the state directly. Such a symbiosis in wartime conditions helps to quickly solve the issue of production of goods, provision of services, performance of works for which there is a demand on the market in wartime conditions. The position regarding the recognition of the association of business entities in the conditions of martial law according to the regional feature – trend is supported. It was determined that conducting business during martial law is a complex process aimed at providing jobs for the population, paying taxes to the state, which will contribute to helping the army and supporting the economy as a whole. Particular attention is paid to the issue of determining the specifics of registration of legal entities, individual entrepreneurs during martial law. The position is argued, according to which, with the beginning of the full-scale invasion, a number of changes in the legislation related to taxation and reporting during the period of martial law were adopted.
В статье проанализированы нормы действующего законодательства, регулирующего особенности осуществление предпринимательской деятельности в условиях военного положения. Учитывая то, что обеспечение надлежащего правового регулирования в сфере осуществления предпринимательской деятельности в условиях военного положения является основой формирования национальных оборонных интересов, проведено исследование особенностей ведения предпринимательской деятельности в таких условиях.
