Запобігання незаконному обігу вогнепальної зброї в умовах повномасштабної агресії РФ проти України

Abstract

Досліджено питання вдосконалення системи запобігання злочинності. Проаналізовано заходи запобігання нелегальному обігу вогнепальної зброї. Визначено декілька основних причин незаконного обігу вогнепальної зброї в країні. Серед них передусім виділяється повномасштабне вторгнення рф, що обумовило безконтрольний вивіз зброї та боєприпасів із зони бойових дій, а також наявність неконтрольованих ділянок державного кордону держави. Стверджено, що превентивна діяльність відносно нелегального обігу вогнепальної зброї має реалізовуватися на трьох рівнях: загальносоціальному, спеціально-кримінологічному та індивідуальному.

The Russian Federation's full-scale aggression against Ukraine led to the deterioration of the criminogenic situation in the country, a crisis in the sphere of social control, and an additional burden on the law enforcement system. In such conditions, measures to prevent the factors of violent crime become particularly important, among which the circulation of firearms is one of the most influential. The purpose of the article: improvement of the crime prevention system. The purpose of the article is to investigate measures to prevent the illegal circulation of firearms. Illegal circulation of firearms can be considered as an indicator that allows assessing the state of national security. The effectiveness of measures to prevent illegal arms trafficking corresponds to the level of law and order in Ukraine. The illegal circulation of weapons increases significantly when social control in society is weakened. There are several main reasons for the illegal circulation of firearms in the country. First of all, the full-scale invasion of the Russian Federation stands out among them, which led to the uncontrolled export of weapons and ammunition from the combat zone, as well as the presence of uncontrolled sections of the state border of the state. It is argued that preventive activities regarding the illegal circulation of firearms should be implemented at three levels: general social, special criminological and individual. Actions aimed at reducing contradictions and stabilizing socio-economic, political, moral-psychological, legal relations in the state and society are considered to be measures of social prevention of illegal circulation of firearms. Special criminological prevention of illegal circulation of firearms is a system of measures aimed at prevention of specific types of crime and its determinants in a certain territory. Individual prevention of the illegal circulation of firearms is considered to be special criminological crime prevention measures carried out in relation to a specific person - a potential criminal.

Исследованы вопросы совершенствования системы предотвращения преступности. Проанализированы меры предотвращения нелегального обращения огнестрельного оружия. Определены несколько основных причин незаконного обращения огнестрельного оружия в стране. Среди них, прежде всего, выделяется полномасштабное вторжение России, что обусловило бесконтрольный вывоз оружия и боеприпасов из зоны боевых действий, а также наличие неконтролируемых участков государственной границы государства. Утверждено, что превентивная деятельность в отношении нелегального обращения огнестрельного оружия должна реализовываться на трех уровнях: общесоциальном, специально-криминологическом и индивидуальном.
